  • Template Letter for Default Removal from CRA

    Hi

    Does anyone have a template letter to send to CRAs requesting Default Removal. We have had confirmation from the OC that they cannot produce a CCA or a copy of the original Default.

    Unfortunately neither of these are required, if an account existed and you missed payments on it they will record a default.

      Unfortunately davyb is correct.

      The lack of a CCA does not indicate that a financial relationship does not exist. The statements of accounts (borrowings and repayments) prove one does.

      The lack of CCA only means the accounts repayment cannot be enforced through the courts.

      The creditors, CRAs and the courts all argue that the CRAs only record the actual performance on an account and if payments are missed then this is recorded and if several payments are missed then a default is recorded.

      A default recorded on a CRA record is not the same as a Notice of Default (under s87).
      They were out to get me!! But now it's too late!!
