  • urgent help !

    hi ,
    I am new to this forum i did search a lot but could not find answer to a similar problem hope someone will help.
    I am in debt of over 22K and not making payments from last couple of years. It include a bank loan, credit cards, overdraft and uni fees?
    I had a CCJ for uni fee on 2007 ? How can i consolidate all my debts and make a payment?
    is it true if i dont pay for 6 years all debts will be wiped off?
    I spoke to PAY PLAN they said if i take a debt management plan with them it will be on my credit file for another 6 years?
    I changed my address but due to some mistake 1 or 2 creditors found out my new address?

    How long is it since you have acknowledged the debt in any way?

    if you have not acknowledged or paid the account for 6 years or more it becomes statuate barred, unless your in Scotland then its 5years. This means that although you may be asked for payments, no legal action can be taken against you for the accounts. UNLESS anyone of them has a CCJ.

    As far as I know, if you have asked payplan about paying the debt, you are acknowledging ownership of the debt, I will ask regarding this.

      Not sure about the CCJ if it was in 2007 then 6 years will be 2012, but does the limitations act extend to covering CCJ's where no action has been taken during the last 6 years since the CCJ was granted.

        just found this about statuate barred.

        • That the creditor has not taken court action against you, eg CCJ, AND
        • You have not made any payments on the debt over the last 6 years,AND
        • During the years, you haven't written to the creditor acknowledging that owe them money.

          thanks for reply.
          CCJ was in 2007 but i did some payment to bailiff company in 2009 as i had an installment plan.since april or may 2009 i havent made any payment to them.For some account i really dont remember when i made payment last time Is there any way i can find out when i made payment?
          Pay Plan i was looking for advice to pay off the debt as i can manage some 100 per month to offer them.
          Please advise how can i make some arrangement to pay off my loans. I know its really heavy amount but i donot want to declare bankruptcy or do IVA. I want to pay minimum payment? does this effect credit history if i make arrangement to pay it back.
