      Hello guys!

      Sorry I hadn't checked the thread because I have been ill. However, I received a response from Cohen today!

      In response to my defence and to avoid further legal action their client (Clueless finance!) are happy to accept a settlement figure of £80 of their debt of £164.50 (95.50 was the debt, 50 court referral fee and 15 solicitor fees).

      At first I was extremely happy, well I am still happy because this is a good result. However, I have not had a response from the court and I am interested to know why the sudden change of heart and vast reduction in the debt...(maybe the debt is not enforceable) What are your views?

        I'd be inclined to wait for the court response. If they throw it out you've saved yorself £80. Did Cohen put a time limit on your acceptance of their very kind offer?

            hello miss

            so cohen sent back an offer did he

            it seems that defence i did has him a bit worried:tinysmile_kiss_t4:

            prob that bit on setion 196 lop act 1925


            WAS THE OFFER SENT BY COHEN MARKED WITHOUT PREJUDICE AT THE TOP (IMPORTANT)

            £15 solicitor fees, he knows he cant add solicitor fees on a small claim track :tinysmile_hmm_t2:

            cohen will now get an AQ from the court and to continue will cost him more money,
            now an exchange of defence has been sent we go into the realms that the claim can never be re-issued again if he discontinues
            cpr part 38 comes into play

            cohen seems to be playing the last throw of the dice before he withdraws as usual

            i myself would drop cohen a line/email and state thankyou for your kind offer but no thank you and i will argue my case in court

            BUT ONLY YOU CAN MAKE THAT DECISION, NOT ME

            the ball is now and truly back in cohens court

            the very worst than can happen is in three months you get a judgement against you, pay within 28 days then their will be NO JUDGEMENT OR CCJ

            so put a few quid away for a few months for a safety net

              I agree with you miliitant, I had a feeling there was something behind this 'kind' offer, especially as the original debt is £95.50 and now they are willing to accept £80.

              I think I will wait for the court response. :tinysmile_grin_t:

                  No updates just yet. my laptop is broken so I don't have regular internet access.

                  I have only just sent a kind response to advise I will not be taking them up on their offer and I will wait to hear the outcome from the courts.

                    Good morning and happy friday to you all! I have some excellent news to share... I received a letter from Cohen saying his client/CL Finance have decided to discontinue the claim. They have attached a copy of a notice of discontinuance which has been sent to the court.. Thank you all for following the post and providing any advice. Extra special thanks to miliitant! Your a star!
