Re: CL Finance trying to get CCJ without default notice - PLEASE HELP!

    Hello,

Just realised my court papers are due back 06/06/2012! What should I do! I've missed the deadline.
Court papers were issued on 8/05/2012 but I am not sure if they will allow an extension beyond the 28 days because of the bank holiday!

just get the papers into the court asap

cohen has agreed the 28 day extension so he prob will not go for a default judgement

the claim is northampton so do it on line now

leave the application order to one side for now

just tell the court that cohen has agreed a 28 day extension and fax that letter from cohen to the court

Re: CL Finance trying to get CCJ without default notice - PLEASE HELP!

I sent off the information for an extension. I received a response from the court advising that my notes had been taken, however action would be taken unless the solicitors request it.

Then, I received the information from Cohen Solicitors, there is the original agreement which was signed in 2004, a default notice which was sent out in September 2011, and the paperwork to confirm GE Money took over the account.

Cohen have also confirmed they have requested an extension until 21st June 2012.

What is the next step for me to take?....................

I have checked online and I can fill in a N244 form for no hearing and the cost is £25. Alot cheaper than if I do it by paper/post

Hello, I am getting a little worried as the court papers are due back in 48 hours and I have no idea what I am going to write in the defence apart from the legal fees should not be added on as this claim is within small claims.

                      Please help!

I know it was a percentage of the balance each month but i can't quite remember what it was for. it was some kind of insurance, it is quite possible it was PPI. I removed it from the account 6-12months later to reduce the payments.

posting a message for the site team

Cohens are not permitted to add legal fees to any claim under the Small Claims Track.

i believe that is under cpr, practice direction 27

can i have confirmation as it will be added to the defence

                                many thanks
