    THIS WILL BE A HOT TOPIC FOR DEBATE AND IS PURLEY FOR EDUCATIONAL PURPOSE.

    most of our statute legislation is derived from common law,
    but does common law (case law) still have precedence over statute to the common man

    some of you will no doubt realise where this is going so please no insults or derogatory comments. my questions are asked in good faith and for my own education

    Case law should never have precedent over statute. Case law can interpret statute but cannot over ride it.

      Case Law, basically, clarifies the law. Statute Law is administrative by its very nature and is often badly drafted and enacted. The basis upon which Common Law sits is as follows -

      COMMON LAW = COMMONSENSE

      As the meerkat says, "Simples".
