  • Wescot called

Wescot called a month ago and I foolishly said I would pay a certain amount per month (I haven't though)....Since then I have found an old credit report which states the debt was defaulted in 2005 and, being in Scotland, I am 100% sure that I have not paid or contacted them in the last 5 years. They called tonight and I would not confirm the security questions, don't think the guy was too pleased. I have a demand letter from them and he wanted to know why I haven't responded to it, I just put the phone down. As I'm pretty sure that it is statute barred, should I just ignore their demand letters and carry on not answering their phone security questions...what would be the best way to deal with it? I'm sure they'll be on the phone nightly now, so what will I say when they ask me why I am not responding to their demand notice?

    Re: Wescot called

This seems to be a duplicate thread, anyway you may want to see this it is from the OFT debt collecction guidance OFT 664

3.15 The OFT position with regard to the recovery of statute barred debt is:
    a. we accept that the situation in England, Wales and Northern Ireland is that statute barred debt still exists and is therefore recoverable. However, in Scotland, statute barred debt is 'extinguished' and is consequently no longer recoverable
