    Don't know where my latest comment went, there was also a reply from labman and it's not here now...strange goings on lol! Anyway I just wanted to thank you guys for your help, otherwise I would have given in to them. Will update when they send their next letter.

      Well, Wescot are back on the scene again, thought I'd got rid of them. I've had no further contact from Iqor though. Wescot thank me for recent contact, acknowledge my query on their account and say collection will be suspended until they contact Lloyds. They will not write unless they require details, the process may take several weeks. Do banks keep paperwork from years ago, 2001 in this case? What do you think are the chances of them still being able to find this?

            Wescot have come back to me...they contacted the client(Lloyds) and advise me to send £1 to them for an agreement and gave me an address LBG, Rosyth, Fife. Account on hold for 14 days. Take it this is just the norm.

              In view of the above, do I have to send a letter to the bank by recorded delivery and do I also have to include 'do not acknowledge debt' etc?

                  At the end of the day either way they are talking bovine as it is THEIR duty to comply with this request.

                    "We refer to your recent communication. Having contacted our client they have advised us that you should put your request in writing along with the £1 fee. The address to write to is etc.....the account is on hold for 14 days, in order for you to do this."

                    If, as you say, it's THEIR duty to comply, what is my next move?

                          After reading the thread, i don't think that you would have anything to gain by requesting a true copy from the OC.

                          They would have no problem in concocting one and it may be that they take this as an acknowledgment.

                          I think everything that you need to say has been said in the letter you sent earlier.

                          If the DCA continues to pester you , you could advise them that it is against guidelines to pursue an account that is in dispute or statute barred, and threaten to report them to the OFT.

                            Am not entirely sure that it's statute barred because of a visit about 4 or 5 years ago from a doorstep caller but can't remember if it was for this debt. I can't remember if I made a one off payment then or signed anything. No ccj's on my 3 cra reports. Thanks Davyb...anybody else care to advise? Still not sure if i should ignore this as they gave me only 14 days for the account to be in dispute.

                              You have contacted me regarding the account with the above reference number, which you claim is owed by myself.
                              I would point out that under the Limitation Act 1980 Section 5 "an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued".
                              I would also point out that the OFT say under their Debt Collection Guidance on statute barred debt that "it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period".
                              The last correspondence/payment/acknowledgement or payment of this debt was made over six years ago and no further acknowledgement or payment has been made since that time. Unless you can provide evidence of payment or written contact from me in the relevant period under Section 5 of the Limitation Act, I suggest that you are no longer able to take any court action against me to recover the alleged amount claimed.
                              The OFT Debt Collection Guidance states further that "continuing to press for payment after a debtor has stated that they will not be paying a debt because it is statue barred could amount to harassment contrary to section 40 (1) of the Administration of Justice Act 1970".
                              I await your written confirmation that no further contact will be made concerning the above account and confirmation that this matter is now closed.

                                Yes it is a good letter, the bit about section 40 of the AOJ act should be left out though.
                                It no longer applies to this kind of agreement.
