Hi. I have today been told by my council that they will take back my liability from bristow and suitor if I pay the bailiff their charges £188 by friday 2nd of march. I just dont understand how the amount is so high. They have posted 4 letters in total through the door (never gained access inside) and have levied a car that was on my drive that belonged to my sister in law and have been to take away said car which obviously was not there when they returned. I told the bailiff over the phone that the car does not belong to me and recieved a letter saying I have to prove to them its not my car! Could anyone advise if I lawfully owe these fees or are they in the wrong? Any help is much appreciated. Thanks in advance.

Tell your sister-in-law to contact B & S and arrange to meet on neutral territory, taking someone with her as a witness. Tell her to take the V5C with her as proof she owns the car. ON NO ACCOUNT SHOULD SHE LET THE B & S REPRESENTATIVE TAKE THE V5C AWAY OR HANDLE IT. Once B & S are shown proof the car doesn't belong to you, they should back down on that point. If they still insist on taking the car, tell your sister-in-law to call the police as a bailiff can only seize property owned by a debtor. If B & S attempt to seize your sister-in-law's car, they will be committing the offence of Theft.Life is a journey on which we all travel, sometimes together, but never alone.

Hi bluebottle. Thanks for the quick reply. Only problem being my sister in law doesnt own the car any more it has broken down and been scrapped! Just not sure how I am going to prove it wasnt my car and avoid these charges before friday.

The bailiff should have checked with DVLA before levying the car - their mistake, not yours. You should not have to pay anything for that.
As regards other fees, you lawfully owe £42.50:
Visit 1 £24.50
Visit 2 £18.00
The council should know this is this the case and should take the case back.

With regard to the car being scrapped, as long as your sister-in-law has the Certificate of Destruction issued by the dismantler, that is sufficient evidence. Seeing that will probably p*ss off the bailiff, but, hey, that's their problem for not doing their job properly.Life is a journey on which we all travel, sometimes together, but never alone.

Just to let you know guys bristow and suitor have taken the fees off the account without even checking with dvla! I have to pay them £42.50 and the council will take back the case. Messycess 1 - 0 bailiff! Thanks again for the advise.

The chances of that happening, CC, are relatively slim due to the sums of money involved. Believe it or not, it costs the taxpayer around £2,000 for a 5-minute hearing before a magistrates court - and that's just for a straightforward guilty plea. However, reporting the bailiffs to the court(s) that issued their certificates and their certificates being revoked for cheating is more of a punishment than a fine or suspended sentence. The reason for revocation is held on record and screams "This person is not trustworthy because they are a cheat." Right I have now paid off the bailiff charges relating to this council tax debt and I have arranged an affordable repayment with the council. However bristow and suitor were chasing both me and my girlfriend for seperate debts (before we met each other) on one letter. One single visit had both council reference numbers on the letter and both accounts have been charged the fee! This doesnt seem right either.

Assuming you were living at the same address, that's because it isn't correct. Your post is a little confusing as you say they've chased you on one sheet of paper for separate debts before you even met. I have taken this to mean you were cohabiting.
Bailiffs are only allowed to charge for one visit to one premises, no matter how many LO's they are collecting for, in one day.
