      Supprisingly the agreement checks out.
      26.2% represents both the fee and the indemnity within the total charge for credit as they should be.

        We moved!
        When we did they, apparently, changed the account number and have not supplied any evidence apart from the "financial statement"

          Incasso (who claimed they were "authorized") have now returned this to Welcome, not a peep from them , so far.
          By the way we never disputed the original agreement, just the issue in that we never got anything to do with a "new" account and nothing transfered to our new address when we moved.
          Progressive Finance appears on the deeds and we know this was/is part of Welcome however we are still investigating this as it would seem they have messed up big time.
          Gone back to our local CA and he has had experience of them before and says they have to "prove" that this "new" account exists!:tinysmile_hmm_t2:

            Having looked over the documents Their Sublime Numptinesses supplied, they seem to make little sense - for one thing, there seem to be three different monthly payments stated.

            Apart from some version of Silly Buggers, do you have any idea of what they playing?

                Phoned the FSCS today, although they cannot do anything do anything pre 2005 they have given me two more phone numbers.

                Direct Group 0844 4124141
                Aviva (Norwich Union) 0800 1584058
                I spoke with them today and they said they will look into the matter and it should take 21 days!
                Worth checking any documents you may have, I didn't even realize Aviva were the underwriters until today.

                  Had a reply from Aviva, another form (ppi) to fill in, then when they get it back the eight weeks begin!

                    Yet more letters from Incasso who apparently "think differently about debt" . Despite a valid CCA (which they deducted from account) and saying it was now back with Welcome they send another "final demand" and the statement they are "undertaking various checks and validations in order for the client to consider the next step."
                    The adviser at CAB says ignore it as the specialist team have now said that because they have made several serious errors in the original agreement and that they have not provided proof that the one they are chasing exists it (they) are" irretrievably unenforceable"You really could not make it up and this in the week some ex directors of Cattles/Welcome got fined a lot of money from the regulator.

                        Update.
                        Another "arrears" notice from Welscum I notced they had used the £1 off the balance so now it looks like we acknowledged it, but why else would we send this?
                        And in the post today one from Aviva telling us we will have to go back to them (again) for the PPI!

                          welcome are the people to claim back all the micky mouse insurance crap from, nobody else

                          with reference the mortage indemnity fee look up WELCOME V GRIFFITHS

                          just looking at the agreement i think it is seriously lacking some PERSCRIBED TERMS

                            As it was silly o clock I only briefly looked at this.
                            Got a link via another site but is a lot to take in will have to study it later!
                            All they quoted to me a long time ago was the Ruskin case and I was uncertain what relevance that had.
                            The CAB have told me that both the original loan (details earlier) and the alleged one they are chasing are irretrievably unenforceable due to the errors in paper work (or lack of them)
                            If I was braver and could afford it I would love to sue them, meanwhile I will just let them carry on digging themselves into a deeper hole!

                                i have it on good authority (full underwriting sheet) i have seen one

                                that welcome use a company called direct group to issue policy documents, well if you can call them that. norwich union now aviva sold their name in bulk to the likes of welcome and direct group. they just use norwich union name, thats all. that is why norwich union will have no specific record of holding any policy. i got all these details through CPR 31.16 (use Ezzias vs Welsh Ministers) and Imageview Management Ltd vs Kelvin Jack

                                ON THE BACK OF THE POLICY DOCUMENT FROM DIRECT GROUP, NORWICH UNION WILL BE NAMED. DIRECT GROUP DO ALL THE WELCOME MICKY MOUSE POLICY DOCUMENTS
