  • Welcome - Incorrect Credit Agreement

    Hi all,

    I'm new to this forum so please bare with me. Took out a car finance with welcome back in 2007. Got into money troubles about a year after, and to cut along story short burried my head in the sand and did nothing. 2 years ago decided to take head out of sand and address problem after a couple of letters from DCA. Cut that story short again. looking at my credit agreement notice that figures did not add up, looks like they have added my deposit to the total amount i owe, also monthly payment x period of loan does not add up to total owe, infact the hole agreement looks mickey mouse. Spoke to DCA see if they could go through it with me they said they would get back to me, which they did only to say they had given account back to Welcome, this has happend with 4 different DCA in in the last year. I take it that means Welcome are in the wrong and can't make me pay.

    Anyone got any advice

    Hi and welcome to Legal Beagles.

    If you have not already done so, make an appointment with CAB and show them this dodgy credit agreement, seek their views. It sounds like DCAs are passing this back to Welcome because, like you, they think its dodgy and they don't want to risk their CCA licences by trying to chase a credit agreement that may not be legally-enforceable.

    Speak to CAB, then come back onto this thread.

      In a different matter Incasso ( who appear to be debt collectors)have now sent one back to Welcome they have not, in nearly three years come up with anything resembling a valid CCA
      We got the first letter from them this time last year and each time sent them "prove it" letters the letter took the usual stance of if you do not pay up we will take you to court etc.
      Took it to CAB who agreed that the whole thing is dodgy but it is still on going.
      think Welcome are well and truly in a hole and trying to get money off people who let themselves succumb to bully boy tactics

        Incasso LLP do not appear to hold a Consumer Credit Licence under either that name, nor under the name of Cobbetts LLP. However, they claim to be regulated by the Solicitors Regulation Authority and are listed by the Law Society (link) as keeping at least one domesticated lawyer. Apparently, they currently keep two at their head office though it is not recorded whether or not they are a breeding pair.

          You say thre agreement was taken out in 2007.
          When exactly, was it before or after April 7.

          With all due respect the CAB are inlikely to give you an opinion on the enforceability of the agreement, is it possible to copy the figures just as they are written onto here.

              Looking through said letters from Incasso the first (from this time last year) claimed they were regulated by the CCA.
              However the last three had changed when it stated they were a limited company (hence the LLP I guess)
              The letter heading has the logo with the statement "Thinking differently about debt"
              Why does it not surprise me that Welcome would use such a company!
              Yet to have anything from them in almost three years
              Check your letters see if the DCA state they are regulated, pay your £1 for CCA don't give up I am not going to!

                Very likely it iswrong but post up the figures. Do you knowif the account was with welcome or with welcome car finance?

                  As mentioned, it is quite important to know what date the agreement was taken out, as if it was after April 7 2007 it will more than likely be enforceable despite errors in the TCC calculations.
