  • Reply To CCA Request from Robinson Way Ltd

Letters posted to creditors 01/02/12 and on 04/02/12 got the first reply. Not what I was expecting though. It was a compliment slip which says

"Please find enclosed your cheque / postal order. We have requested the information you require and have sent you a seperate letter explaining our process.
    Your Sincerely
    dbsg Debt Buyers &Sellers Group
    Correspondence Department"

Wonder how long I will have to wait for the "information I require"? Will I get it within the required 12days + 2? I await the 17th of February.

    Hello OfWolfandMan,

What information were you requesting from your creditors? It sounds like your creditors sold a debt on.

Could you provide some more details, please?

It it's Robbers Way, you might be waiting a very long time. They tend to specialise in SB and UE debts.:beagle:

Of course, the firm cannot accept your payment (stat. fee).
            What a predicament...

Re: Reply To CCA Request from Robinson Way Ltd

I'm not sure of the legal standing on this, but I have seen CCA letters where it is stated that the return of the statutory fee does NOT absolve them of their legal
obligation under the Act. Provided the fee was proffered - then the request was lawful and binding under the CCA - is the way that I read it.

If my interpretation of that is correct, then they have put themselves in breach of the CCA - NOT by returning the fee - but by considering that to be sufficient for them to avoid compliance.

What you now have is a written acknowledgement of the receipt of the fee, and thus the receipt of the lawful request, IMO.

              Priceless ? Maybe not - but b100dy useful, I reckon !!!
