    Greetings fellow Lowell Lovers

    It would appear that the Leeds Losers have purchased yet another lot of UNENFORCEABLE debts to their portfolio.

    Many years ago M&S chargecards were changed to Credit Cards without anyone asking for them. Now the consensus is that there was never any agreement signed nor applications made for the Unsolicited Credit Cards. The alleged debts have done the rounds of the usual suspects and have now landed at the Leeds Threat Centre of Clownells. It will be interseting to see whst if snything they come up with by way of an agreement

    Consumer Credit Act 1974

    51 Prohibition of unsolicited credit-tokens.

    (1)It is an offence to give a person a credit-token if he has not asked for it.
    (2)To comply with subsection (1) a request must be contained in a document signed by the person making the request, unless the credit-token agreement is a small debtor-creditor-supplier agreement.
    (3)Subsection (1) does not apply to the giving of a credit-token to a person—
    (a)for use under a credit-token agreement already made, or
    (b)in renewal or replacement of a credit-token previously accepted by him under a credit-token agreement which continues in force, whether or not varied.

      So in essence now that the Leeds Losers have purchased the Rights and RESPONSIBILITIES of this alleged debt the are responsible for any offences committed. M & S were warned back in 2003 by the OFT. That what they did was wrong hence the debts passed from DCA to DCA. Also why despite numerous threats M & S never took anyone to court.

          Yes there was a great deal of discussion over on GAG about this with one of the more sensible members begging Marksies to take him to court

              Be interesting to see how many new threads have been started OTR. The HELLo letter from Clownells was accompanied by a pi55 poor letter purporting to come from M&S with identical typos.

                Methinks it's time for the OFT and BIS to stop pussy-footing and faffing around and pull down the shutters on Lowells et all for good. Time to embarrass the politicians into doing something about it? You bet it is!
