    Hello
    I have been looking around the forum and i admit I am going around in circles a little about where to place my question.
    I obtained a copy of my credit report and have a number of defaulted accounts, which I am attempting to sort out; also I have an attached address that I know nothing about.
    I e-mailed Experian and they said that Welcome finance had placed the entry, and that they had checked with them and it was correct. I have never heard of the address. They say they would put a dispute note on the account, but up to date they have done nothing. I e-mailed Welcome and then talked to someone on the phone who said he would remove it but nothing happened.
    I need to start making arrangements to pay the other accounts on there but I want to get this sorted out first. Any suggestions to whom I pursue, the agency or welcome.

    Hi lindalou,

    Presumably the disputed debt is not statute barred (ie it's less than 6 years old; 5 years in Scotland)

    I would send an SAR (but do not acknowledge liability for the debt) to Welcome, see what, if anything, they've got.

      Thanks for this and i will do as you say.

      But my query was about an entry on the linked address part of my report.
      Welcome have put an address on there that i know nothing about , i live in the north of england and this is in Edinborough somewhere.

      I got the credit report from Experian because i am thinking of starting a debt management plan and discovered this.

      I rang Experian and they said they would put a note on my file and get back to me. Which they later did, saying that Welcome had confirmed the linked ddress.
      I rang welcome and the man said that he could not see why it was there and he would get it removed, three weeks later still nothing.
      What i want to know is who do i hold liable for this, is it Experian or Welcome.

      I am trying to get my debts sorted but feel i cannot if they are going to have someone elses finances linked with mine on the report infulencing my credit score.

        If Welcome have provided the address then it is them you will need to tackle firstly. Your SAR should yield information and if there is nothing about this address then you can dispute their CRA entry.

          I am quite annoyed with Welcome they assured me that this entry would be removed as they admit that it is not a linked account and has no business being on my report.
          In theory could I take any kind of legal action against them if they do not remove the entry?

            Hi LL,

            Personally, if you've been told by WFS they will remove the default, I would e-mail them again and ask them to e-mail back their response so you have it in writing that they have said it.

            Once you have that, then you can give them a deadline by which to do it, otherwise you will force compliance through the courts along with a complaint to the ICO.

            Under the DPA, one of the eight fundamental principles is that data held must be accurate. The data controller of WFS is personally liable for any incorrect data processed by them.

              On taking advice I now intend to take action against you in the county court to recover costs, and for defamation.
              I also intend to report you to the Information Commissioners Office for breach of statute.
