    Hi guys, posted before and didnt realise there was advise on Debt companys so here goes,

    I will say l might of already dropped myself in it by setting up DD but here the story.

    I had a debt from Lowell Financial for a debt from 2007 for Barclays Bank. The amount is £319 and l was un-sure what the actual original debt was. I rang them and asked to supply details which they said they would request and get them too me. I asked for time scale and they said they couldnt give one but i NEEDED to set up direct debit to pay debt off while l was on phone or would be passed to Red Debt collections. Bit worried about this l agreed and set up DD with them but reading some horror storys on here wondered if l have done right thing.

    Any advice would be welcome as in do they have a time period to send out documents from Barclays?

    Lowells and Red are the same company, along with many other names, so I wouldn't worry about their threat.

    Interms of asking for anything else, personally I'd cancel the Direct Debit, and have a good read of this:

        I won against this pathetic bunch of low lifes, yes ten thousand quidv written off. They are chancers who use bully tactics to extract money that most of the time they are not entitled to. See my threads elsewhere on here. Cancel the DD if you have not already done so. Send them a Prove.it letter and a CCS request, etc. They are so stupid that they will make mistakes along the way.

          Both of the above referenced in my first link, but just in case you get confused, it's a CCA request - simple typo.

                  Click on this link - Legislation.gov.uk

                  and download copies of the following Acts of Parliament -

                  Theft Act 1968
                  Protection from Harassment Act 1997
                  Fraud Act 2006

                  Print off copies of the following sections -

                  Theft Act 1968 - Section 21 (Blackmail)
                  Protection from Harassment Act 1997 - Entire Act
                  Fraud Act 2006 - Entire Act (Fraud by False Misrepresentation; Offences Committed by Bodies Corporate; Liability of Company Officers for Offences by Companies)

                  Also, go to the OFT's website and download an up to date copy of their "Debt Collection Guidelines" document and keep it handy.

                  Should these chancers still persist, send them the above extracts, highlighting the relevant passages and warning them you are prepared to involve the police as well as OFT if you are forced to do so. Letting them know you have an up to date copy of the OFT's "Debt Collection Guidelines" can unsettle them as it's harder for them to feed you a load of manure.

                      Go to the OFT's website and download an up to date copy of their "Debt Collection Guidelines" document and quote from it in correspondence.

                      Also, go to Legislation.gov.uk and download copies of the following legislation -

                      Theft Act 1968
                      Protection from Harassment Act 1997
                      Fraud Act 2006

                      Section 21, Theft Act 1968 (Blackmail) is very useful for dealing with the threats made by DCAs.

                      Sections 2 and 7, Protection from Harassment Act 1997 are useful for dealing with persistent and unwarranted demands from DCAs.

                      Section 2, Fraud Act 2006 is useful for dealing with false claims made by DCAs that you owe a debt and Section 12 is a handy one to throw at a DCAs management team.

                      In my experience, DCAs tend to back down once they realise you've done your homework and aren't going to take any bull from them. The loss of their CCA licence is the one thing they fear most. Go for it and don't let them push you around anymore.
