    Working on lowell for the OH at the moment in relation to a disputed debt with 3G mobile.

    SAR sent to 3G August 2010 along with a £10 postal order and guess what 3G decided to use the £10 for lol............yes they thought they would deny having the SAR which it was enclosed in the same envelope with and use the PO to reduce the debt by £10 to restart the nearly time bared Limitation Act.

    3G still not complied with SAR and so ICO complaint sent. Lowell keep sending letters saying they have now liaised with their client who have explained not recieving the SAR therefore the money was taken off debt. Good job copies were kept.

    Have them all reported to every authority you can think of & even the police for theft/fraud if necessary (not 999)

      So, they stole the money, withheld information and 3G have broken Section 55 of the DPA act. Apart from that, all is fine.

          What's the situ on legal aid these days? Does it still exist? We need to form consumer unions like the trade unions so that we can afford group legal representation, the courts are still light years behind accepting LIP's points of view.

              Yep they phoned my OH again yesterday when I was out, she held her own by all accounts (shes been listening to me quite a bit lol) idiot there was talking over her she threatened him with harassment and said she had just had a baby (which is true well 7 months ago), sleep deprivation is prob not a good mix when talking to thick dimwits from DCAs lol

              I am knocking up a letter to send them now

                I suppose we should be a little more polite at present and simply use the term 'misappropriation.'

                It might be interesting to ask them exactly how they knew which account to pay the £10 into, if all they got was a PO without a DSAR - or any covering letter of any sort. Be interesting to see them attempt to forge a covering letter !!!

                  Tanz, it would be worth giving Consumer Direct a call.
                  Please ensure that Consumer Direct logs the details of the complaint with the the OFT;
                  the OFT keep stats. on each firm e.g. The Lowell Group.

                  These firms know full well that a £10 DSIR statutory fee must not be used for any other purpose.

                  The legislation is well laid down!

                        Looks like the Leeds Losers have recently purchased a bucket load of old dead telecom debts...

                        Makes you wonder why they don't buy decent portfolios?
                        But of course same would cost them more than 1p in the £1!

                          Looks like my old BT chestnut will be on the doormat again, soon, then !!! Not Statute-Barred yet, but - "arguably" - CCA unenforceable. Sigh...
