    Hi guys,

    I posted an intro yessterday saying I had no real problems, just a few letter from MuckyHall regarding a statute barred debt, but, this morning I received a letter from Capquest. It is regarding Natwest, and a debt due to bank charges from about 2007. I disputed the debt with Natwest at the time, because it is literally all because of ridiculous charges. I heard nothing from them apart from 1 letter. which I completely forgot aout. That was about 2 years ago.

    Anyway, this letter from CapQuest says that the debt has been sold to them (although letter from Natwest states that they are acting as their agents) and that if I don't respondby 28th December, my account will be passed on to their solicitors, H.L Legal, and they 'will not hesitate to utilise the legal system to it's full extent'.

    Not quite sure what to do about it. I always pay debts that I owe, unless there is just cause to dispute. I really do not want to be paying £459 (that is the amount of the debt), because of Natwest's stupidcharges. I closed the account in 2007, disputed the charges and heard nothing from them since, apart from a letter. Now this.

    Any advice?

    As it's the first letter, file it under I.
    As and when they send another then a simple Prove It can be very useful.

      Yes just ignore & report them to the OFT,trading standards if they keep harassing you.

        Well well, I got this letter the morning, and apparently have til 28 December to respond, but I just googled a number that has been calling me and turns out its H.L Legal Solicitors. I'd love to know how they got my number. Would it be a good idea to answer them and tell them that I owe nothing and to stop harrasing me?

          HL are merely Solicitors-For-Hire and sell templated threat-O-grams to the DCA industry.
          Best ignored as they'll only direct you to CQ anyways.

          As and when they call again simply refuse to answer their data protection question and inform them that you require ALL correspondence to be in writing for the avoidance of doubt.

              These laughable "solicitors" are nothing more than another desk in the DCA office - just another part of the crazy game they like to play to make the situation seem like it's more serious than before.
              Only a proper court has any legal powers over an individual in this country - no one else.

                I have had a second letter from crapquest this morning stating that my account was being passed to their 'pre litigation' department? What the heck is that all about? Another attempt to make me call them I guess.

                  Now that you have received a second letter it is time you followed the advice given to you earlier in the thread by Curlyben and send the prove it letter.

                  Or alternatively send the letter below along with a copy of your original letter to the bank disputing the charges.

                  Letter to send when DCA/BANK are attempting to collect on penalty charges that are disputed.

                  ACCOUNT IN DISPUTE

                  Dear Sir/Madam,

                  Your ref:

                  Thank you for your letter of **DATE**, the contents of which are noted.
                  I refer to my letter of **DATE** a copy of which is enclosed for your perusal and ease of reference.

                  As holders of a Consumer Credit Licence you are obliged to comply with the Office of Fair Trading Guidelines on Debt Collection. I would therefore be obliged if you would provide me with an explanation as to why you are attempting to collect on an alleged debt which was disputed with **BANK ** prior to your first contact with me, and has yet to be resolved.
                  As per OFT guidelines Section 2.8k "not ceasing collection activity whilst investigating a reasonably queried or disputed debt."

                  Since this is considered an Unfair Practice and contrary to the OFT guidelines, you should consider this letter as a formal complaint, and provide me with a copy of your complaint resolution procedure.
                  I also require you to confirm that you will now comply with the OFT guidelines, and will not attempt any further collection activity whilst the dispute is unresolved.

                  After taking advice, I am of the opinion that your continued pursuit is in violation of the CPUTR 2008, Protection from harassment Act 1997 section 3 as well as breaching a number of the OFT Collection Guidelines.

                  Should you fail to provide me with the required undertaking within 7 days, I shall report your breach of the OFT guidelines to Trading Standards and the Financial Ombudsman Service.

                  Take notice that I will not discuss this matter on the telephone, and all further communication must be in writing. Any further Telephone Calls will be perceived as harassment, and dealt with accordingly.

                  I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you would prefer to do this than merely respond with standard letters and leaflets.

                  I would appreciate your due diligence in this matter.

                  I look forward to hearing from you in writing.
