  • Ruby vs Aktiv Kapital

Hi guys. Been a while, however I would greatly appreciate your input.

in 2000 AK bought a credit card debt for circa £6500 from MBNA, we have paid £3500 of this however stopped paying them altogether when the account came into dispute in 2007 over no CCA. The account has been round more DCA's that I care to mention including mackie hall. I have had all the usual threat-o-matic letters but recently got the hell in and responded to one of them saying they probably owe me money due to all the unfair charges imposed by MBNA at the time and the OFT ruling in 2006. MBNA were charging fees of £24 for late payment/over limit.

Account now back with AK who say they legally own the debt but have suggested I contact MBNA with regard to charges etc. I have now SAR'd MBNA as of last week.

Two things stick in my throat in particular. Technically we still 'owe' £3000 however according to AK records we owe over £10K as they have put their own charges on. They are not a lending organisation - surely it is illegal for them to add their own interest? especially to the value of £7K!!!! Secondly, what do you think are the chances of getting any charges refunded from MBNA considering the account was bought by AK in 2000? I genuenly feel I have paid them enough considering all of the above.

Another interesting thing is that I still have a copy of the letter from AK dated back to 2008 stating that they are willing to write off the debt for £150. They did not state a time limit. £150 for £10K!! Mmmmmmm :tung:
