Re: Help removing paid default - Lowell

Lowell is telling me that the account belongs to them and that they bought it off of orange.
In that case I would be asking Lowell for a copy of the assignment notice (without telling them why you want a copy of it) because if the date on the assignment notice is BEFORE the date that the default is registered on your CRA report then that default is invalid which means the assignment is also invalid

Hey guys, i know its been a while since i posted in this but i've been arguing left, right and centre with lowell (with a little backing from experia).

      Lowell's latest reply .......................

      Dear Mr Brine

      Lowell Reference: *********
      Original Creditor: ******
      Original Reference: ********

I write further to our conversation of 9 December 2013 and would like to thank you for allowing me the opportunity to review this matter.

As discussed, as a gesture of goodwill I have arranged for any information being reported by Lowell Portfolio I Ltd to the Credit Reference Agencies in relation to the above account to be removed from your credit file. Please note that this process can take up to 50 days.

I trust this action has resolved matters to your satisfaction, but if not please let me know.

      Yours sincerely

      *************

P.S. Many thanks to FlamingParrot and Gorang, you guys have been awesome !!!

Re: Help removing paid default - Lowell

Well your post got me thinking about the notice of assignment and it made me remember that orange definitely didn't register a default on my credit file, so i rang CreditExpert and got them to check my credit file history.

They informed me that all of my accounts were up to date and paid in full up to the point that Lowell registered the default. For some reason this annoyed the Creditexpert adviser loads lol. So he fired off a letter of enquiry to the Lowell complaints department.

He hadn't heard anything back so i rang them up myself and explained what i had been told adding that because they were not the OC they had no right to tamper with my credit file unless they was an existing debt, which i had been told there was none.

The Lowell rep (who was extremely helpful i must add) listened to my concerns and checked back on the credit file entry and she noticed there was only one entry, there was no late payments, just the one entry stating the default existed. She was extremely confused and agreed that it shouldn't exist as she could not find any original debt so agreed to remove it.

(Just to cover myself i got that lovely little e-mail sent to me as proof so if it doesn't happen they'll be getting a copy of it sent to them.)
