I know but unfortunately the monthly payment was in arrears so I was told that because of this it was not a proper voluntary surrender. Its all very odd.

Yes they do say that if you have arrears on your account.
But it is nonesense.

There is nothing stopping you from terminating you car under section 99 even if there are arrears on your account
