  • Debt...Lots of it

    Since my partner left me, i have been juggling my finances.
    I have currently 4 agenceys which i am corresponding with and negotioating payments with.
    In 2006 i took out finance on a car. Which 2 months after taking it out i paid it off, the full £6000.
    I since then have sold the car to a big car company who gave me £5k cash for it.
    Yesterday i go a letter from GE Winchester saying i had not paid it.
    I have had no correspondence regarding this since 2006.
    I am ignoring this as i have paid it.

    I am trying to sort my finances out with these other agencies and i am offering to pay monthly.
    I just cant understand why after nearly 6 years they have suddenly written to me demanding the money.
    If it had finance on it Carcraft wouldnt have bought it from me.
    Puzzled..

    Did you get a letter confirming the money was paid back?(I suspect that because it is nearly 6 years(re statute of limitation) that they are fishing for it).

      No i didnt but i suppose i could go to my previous bank and get a statement to say the money went out and to which account number ect
      You cant sell a car if you have finance on it (or at least what i thought)
      I bought the car in April 2006.
      Its almost 6 years ago..why now??

        The reason they will be writing to you now is that they believe the debt is outstanding and after 6 years debt is Statute Barred if you haven't paid anything or acknowledged the debt in that time. I believe in seeing them off and would send them a copy of the receipt if you have one otherwise they will just hound you. If you don't have a receipt, you can always trace the payment back through your statements and give them the date and method of payment.

        Don't be pressurised by any DCA to pay more than you can afford. If all you can afford is £1 per moth to each of them, that is what they get. It is down to you to decide what you can afford, not them.

          It is up to GE Winchester to prove the debt exists NOT the other way round IMO

          I pesonally would send GE Winchester a short letter along the lines of

          1. prove the debt exists

          2. if you can't prove it and keep harrassing me about this then I WILL persue your company for harrassment with the full extent of the law available to me

          3. there is NO debt because I took out the finance then Paid it off 2 months later IN FULL (but do not provide any dates here, let them do the digging)

          4. No I will NOT prove what I say is correct, as you should be checking that there is an actual debt to be reclaimed BEFORE you send letters out harrassing law abiding members of the public

          5. If your company has bought or been given this as a unsettled debt then a bunch of dummies have bought or been given a dummy and the source has seen a dummy coming

          6. So I suggest that before you do anything more, you should go back to the source, where you got this information from and double check it, before you waste any more paper, or more importantly, my time

            I agree with above, but tbh if you have the proof to hand, then I think you may as well send it in the first place, and put an end to it sooner rather than later, otherwise you'll be playing letter tennis with GE. What's the point of that? Might as well get it done and dusted and out of the way now.

              Thanks Guys,
              Ive just emailed the bank (who i no longer bank with) to ask how i can go about getting my statements from 2006 to 2007.
              Then if and when they do start harrassing me more often i can smak them with this.
              I am taking steps to resolve this.
              PINKY....Thanks for the advice, i have offered the DCA's a resonable amount to pay back to each one of them.

                A very good chance they are going to come back and say it will cost you £5 a statement

                Don't fall for this garbage

                If they say that then just send them a SAR with a postal order for a bargin price of £10 for all for your statements and info they hold about you

                      If you don't respond and do nothing

                      what will likely happen is

                      you will get more and more letters through the door

                      they could also register a default against you
                      then you have a battle on your hands to get the default removed as you have no proof that you challanged this alledged debt

                      BUT

                      If you do respond with a prove it letter like suggested above then they go and still register a default you will be in a far stronger position to get the default removed

                      At this stage I personally wouldn't go looking for the proof (ie spending a tenner on a SAR) to throw at them to show that you have paid it off

                      but I would make up a prove it letter (and leave the onus on them for the mo to prove the debt) and send it recorded delivery so you have proof of delivery

                      If they do still keep coming after you then thats when I would get the proof, and it would also be the Finance company that you took the car loan out with that I would send the SAR to
