    Hi.

    I received a letter today from Link actually it was a statement. Statement number five. Not sure what happened to the other four.
    After telling them they no longer own the debt and have not since 2004 and have proved to them that A, The debt is statute barred and B, I pay another company and they still have not sent me any proof that they own this debt or indeed that it is mine as I have disputed this debt with them for over a month now.

    They send me a statement with two transaction descriptions..

    1. 29/01/2011 Balance brought forward 8,335,95
    2. 31/07/2011 Balance carried forward 8,335,95

    Up untill a month ago I had never even spoken to these people since 2003 and then it was just to acknowledge a payment plan for which they only got one payment as in 2004 another company took over.
    What worries me is the dates, it looks like they are trying to reset this debt and I'm pretty sure its statute barred. They wont take any notice of me.
    What would you advise I do, I just know the threats will follow soon.

    I even got Wescot to write a letter proving they own the debt and I'm paying them but they just wont except anything I send them as proof.

    If Link do not have an absolute assignment of the debt to them, there is little/nothing/bugger all they can do.

    File their letters, but do not respond until/unless they produce proof that the debt has been assigned to them.

    If you have been paying since 2004, the debt is unlikely to be statute barred.

      Ignore them both - they have no legal power to any money off you - only a court does.
      Report them to the authorities if they refuse to leave you alone.

        I just wish I could get it into their heads that I am paying the debt but to the DCA that own it and it is not Link Financial.

        Thanks for your support. I dont think this is the end. I just know I have more to come from them.

          Hi Sharnie and welcome to LB!

          CC is right that if you have indeed been paying the debt all this time it will not be statute barred. If you had a clear 6 year break where the debt was not acknowledged in any way and you made no payment to it, then it should be SB. If in doubt, send an SAR to the owner of the debt and you'll get all the information they hold about you including statements, dates of payments etc... for £10. You need to be pretty sure it is SB though, as sending an SAR is, I believe, perceived now by courts as acknowledgment of the debt.

          Don't talk to them on the phone at all, and if they phone you refuse to go through security and ask for everything in writing "for the avoidance of doubt."

          Then wait.... see what happens, and when something does post up again.
