I received a letter today that Moorcroft have given up the ghost in chasing my alleged debts in dispute and the "accounts" are closed. This is the second time they have had to fold on this - they tried 2 years ago. The reasons for the dispute are 1) no agreements just application forms 2) concocted statements and 3) no Terms and Conditions. In the course of trying again, Moorcroft earned a report to the OFT - again - for attempting to collect alleged debts in dispute. The funny thing about their letter is that they said they had tried to help me resolve the dispute. Que????? They are definitely completely barking!

Good for you Pinky. As ever, an inspiration. You should go to the FOS as well about the debt chasing while in dispute and wangle some compensation out of them. Of all compensation and refunds I've had back these past 18 months, the sweetest was the cheque from CapQuest.

1990's took aloan with TSB.Jointly signed with my wife.I went bankrupt 2003.Lloyds TSB Collections sold the debt to CCS,now Moorcroft have it,But they are pursuing my wife as co-signatory,not me.we /she has been paying £20 a month,but now we are in dispute with
Moorcroft,after their initial letter threatened court action and subsequent phone calls were
very aggressive.Any advice on the best route to take ?

Thanks all,I think that paying 20 a month for a few years probably acknowledges the debt.? Last paid May.But It's the fact that she does not owe the as she had no income,never paid into the account as she did not work,or need to work at the time. We are thinking of saying to LTSB,go to court.At the moment the acc. is in dispute,so no more threats from Moorcroft for a while.Any advice,tips really welcome.Can't get back until Saturday now ,but looking forward.

It's a bit hard faced to take out credit and then some time later fail to repay it, but the fact is a creditor must prove you agreed the the prescribed terms of a credit agreement in order to sue you for it back.They were out to get me!! But now it's too late!!

Indeed, from a strict reading of sections 5 and 6, one might believe that the alleged debt would become statute barred on the sixth anniversary of the date on which the cause of action accrued, regardless of whether or not it had been partly paid or acknowledged in that time.

Pinky, I am having a wee spat with Moorcroft re an RBS loan. In a nutshell I sent a letter requesting a copy of the agreement in December 2008 3 months later they wrote to say they could not find it. I stopped payment immediately. Two years later Sept 11, Moorcroft Phone to say pay up or else. A years worth of correspondence (they have failed to provide any documentation) The ac is clearly in dispute but they persist with their threatening drivel. Any thoughts?
