  • robinson way - captial one,demands.

    i received a letter from robinson way last week, asking me to confirm that i had previously lived at a certain address,i hadn't so i googled them, saw who they were and ignored the letter.

    this letter contained no information as to why they had written to me.

    yesterday i received a demand from robinson way asking me to repay £1512. for a capital one card,they outlined the various nasty things that could happen to me if i didn't cough up.

    i cannot recall ever having a capital one cardor if i did it would have been over 20 years ago

    my daughter says she had a capital one card and had a 6 month battle with them about 5-6 years ago, the outcome of which she paid an amount in full and final settlement, and never heard from them again.

    do i just rwite to robinson way and ask for proof of the debt?

    Sounds about par for the course I'm afraid.

    DCA's like to threaten all sorts in an attempt to brow beat you into contacting them and making a payment.

    Now you are perfectly correct in wanting to know more about this alleged debt, as such a simple Prove It letter goes a long way.

              thank ben , i sent a prove it letter, they wrote back asking if i suspected fraud(if i wasn't the right person) and had i reported the fraud( if i wasn't the correct person) and did i have a police incident number if i had reported ( the fraud).
              i think they meant this to mean that they could never be wrong in having got the wrong person.
              they told me the date the account had been created, and the date of the last payment,(nov.2005).

              i told my daughter about this letter and she said' oh, that's about right, i had a capital one card and had a huge argument with them in 2005,that had gone on for a year, and i sent them a payment in full and final payment, and i had to sign some thing that confirmed the whole account was settled and i never heard from them again'

              obviously i do not want to drop my daughter's name into the mix and have them chasing her, instead of me, but they do have it wrong, the account they are talking about is not mine.

              what should i do next?

              p.s by the way they have put the account on hold for 14 days.

                It is NOT your place to acknowledge the debt, but theirs to demonstrate that they are lawfully pursuing it.

                  thanks ben, so do i ignore them? move house? or once again ask for proof of the debt?or ask for all the paperwork associated with this debt?

                  if they had the orginal agreement, they would know it's not me they are they after.

                      Had a phone call from this lot this evening, told me they had "written" to this address (nothing received as yet) asked me to confirm date of birth etc, refused, hung up and have put the number on my "barred" list!
                      may need to review a "prove it" letter if they do write
                      Well nothing in the post even though the person who I spoke to said that the letter was sent on the 20th of July, now I know the post is slow around here but NINE days?! will keep you posted!

                        Well letter arrived dated 29th July its so pathetic its almost comical, its for a Bank of Scotland Card which is with the FOS for PPI and this is upheld, whilst this was going on I provided them with income and expenditure and have an agreement (in writing) to pay £2.00.
                        I do not want to reply to these clowns other than a "prove it" letter (there was no "assignment") just a claim that they had been approached by BOS to get payment for the outstanding amounts etc (very sweet that they also said that it was in my interests to contact them as it would cause me less worry!)
