  • How to pay the OC

    Hi all
    Debt Star brought up a valid point this morning about paying the OC instead of their DCA how do you go about this I dont internet bank and have had direct payments returned
    If they have not sold on the debt why is it such a problem to pay the OC

    Winner, I think you need to put the account in dispute and then shake off the DCA. Continue paying the OC and nowt to the DCA. I believe that lenders can insist payment is made via their agents but those agents, as I understand matters, cannot manage your account if it is in prior dispute. Exceot that in my case I started a dispute with BOTH the OC and the DCA years after the DCA had started collecting, and eventually they burgered off. Lol, I even complained to the FOS about the DCA as well and got compensation from 'em despite the DCA doing anything particularly 'wrong' in their own industry norm.

    Stick at it. Try different tactics.

      The problem there DS is in your response. The DCA cannot collect if the account is in prior dispute with the OC. Who is the DCA? There will be a way to get rid of them.

        My account wasn't in prior dispute though, as I said. I kicked off my Egg War years after paying CapQuest and still got shot of them (eventually...it took a few letters and formal complaints to and about them but they pished off eventually). In any event, I stopped paying the DCA and started paying the OC DESPITE the fact that Egg "could" insist on me paying the DCA. Its was fait accompli and the FOS involvement gridlocked everything anyway (since I Fozzed both the OC and DCA). As I said, I found a reason to dispute the account and although cappy initially wriggled around saying no "prior" dispute blah blah they went eventually. I attacked them on breaches of the OFT Guidelines from memory which, while my complaint wasn't upheld, still resulted in some £ and best of all saw 'em orf.

        I am convinced that the consumer can find ways to sideline DCAs. I know I have.

          Computer blip so just getting back to you
          The original Debt is Monument and the DCA is Circuit
          Monument have not sent me a notice of assignment or any other info so i have complained to Monument and not heard from them either
          I have paid them for the last 12 months on time as per my DMP
          Out of the blue got the letter from Circuit
          But I want to still pay Monument direct but I dont internet bank I pay them monthly by cheque
          Debt Star pays the OC direct so im curious as to how I can do the same
          CAP1 have never accepted my direct payment since last august I think but Id prefer this one not to go down the same route
          But I dont see why I should pay any DCA that comes out of the woodwork
          and would like some amo to see off Circuit

            Winner, to be clear and before Caspar gets to post in response, I kicked off a dispute with the OC and also complained to the DCA. Simultaneously I stopped paying DCA and started paying the OC. That was 12 months ago and no one's done 'owt about it - yet.

              So I guess my dispute is that Monument never notified me before passing me on to a DCA so until Circuit produce proof and Monument tell me whats happening (and still accept my direct payment) its in dispute which gives me time to SAR them and see what that throws up

                Hi Winner,

                Have you read the EU Directives recently come into force. It states very clearly what should be done about Notices of Assignment. One thing it does state is it is only ever OK to not send a NOA if the OC is still receiving the payments. As you have not received one, then one has to assume under the EU Directives that the OC has to, by law, still accept payment. It might be worth pointing this out to them.

                  I have done alot of reading on lots of points recently but missed that one I do hope these new directives help us all along the way to sorting out our debts and making payments instead of being treated like C**p from the onset from nothing more the licensed Bully Boys
