    Hi
    Got an account with Monument and have been paying them £16 a month on my self managed DMP (balance is £4200)
    I received out of the blue a letter from the above DCA (who thinks up these names) I sent a prove it by recorded delivery
    I have today received a letter threatening court action attachment of earnings charging order etc unless I pay up
    What do you normally send after they have ignored your prove it letter
    I have also paid Monument direct this month and will check they have accepted my payment I have had no notice of assignment so Im assuming they are collecting only on behalf of Monument

    If you have received no NOA then they are collecting on behalf of monument (however, its not unknown for a debt to be assigned and no NOA turn up)

    Do you know how long you have been paying reduced payments to monument? Its possible that the reduced payment plan had a finite time on the agreement. A friend of mine had a payment plan with a creditor and after 12 months the computer just passed the debt to a DCA as no one renewed the plan in their system (it took manual intervention). In cases like that the original creditor just pass the debt to a collector when the payment plan 'expires'.

    Its probably a good idea to call monument and ask them what the state of play is. Point out that you have kept to the agreement, have been paying on time and the agreed amount and would like to continue to pay. Also point out that due to your financial circumstance, passing the debt to a collection agency is not going to result in a higher payment and just makes life more difficult for all concerned. Thats probably the easiest route to start with. Its possible Monument try to mess around, but lets cross that bridge if it comes to it.

      I have been paying Monument about 12 months so you are probably right there
      So do I just Ignore CFS for now until I find out whats happening

        I would for the moment. Get on the blower to Monument and give them a nudge, see what they say.

          UPDATE
          Hi all
          Got a letter from the above today thanking me for my letter (Which was a prove it)
          no word relating to proving the debt can be collected by them just another different ways to pay letter
          I did complain to Monument who are the original creditor asking why they had not let me know they had passed me on to Circuit but have not heard from them either
          Is it best to sit tight and ignore the above still paying Monument direct at present as per my DMP

              What would happen if Monument did not accept my payment (as per my 1000 stories related to CAP1) who should I pay (Im sure the OFT guidlines state they should let you know who is collecting the debt)

                I had a similar situation with Egg. For years I was paying a DCA. Then I thought, **** it, I'll pay Egg direct and screw the DCA. Trouble was, I didn't know Egg's banking details as tehy had long ago stopped sending me statements and withdrawn internet access. I did manage to get an account number from these forums and just started paying Egg direct, at the same time as disputing my debt with them and shaking off the DCA. I followed Amethyst's advice to pay my creditors and didn't go down the route of stopping all payments. What I have found is that Egg are taking the payments I can afford to send them, not what they want to receive. Has worked well thus far. So, if it was me in your shoes and if Monument rejected my AP, I'd still pay them anyway regardless.

                  I did try paying CAP 1 by bank transfer then cheque all were returned so have not paid them for months now and no one has contacted me yet
                  Very weird they spouted about my recon CCA being enforceable does make me wonder though why they have not started court proceedings
                  I think my account with Monument was originaly with Providian so I reckon they have no chance of taking me to court either

                      obviously you are aware that at some point they will want their money. All I can say is that with Egg I was paying CapQuest via CCCS. Came off the DMP, paying CrappyQuest direct. Then I disputed the account with Egg, originally on CCA grounds but when I got my SAR it uncovered loadsa other reasons to dispute instead (charges, PPI, mis-selling of a consolidation loan etc etc) and I stopped paying altogether for about a year. But, it was obvious that Egg would want their money sooner or later. I was also advised on here to pay them but what I could afford (as opposed to what the DCA wanted, which kept being bullied upwards). I think it was Nattie on here who helped me find Egg's account details and the info I'd need (I think it was him, but in any event there are ways and means to find that info by digging around a bit). So I started paying them what I could AFFORD and sent an i/e sheet as well. They take the payments and update my credit files each month so I have proof of their acceptance of my default AP.

                      In the meantime the FOS got involved with my complaint on PPI etc. I got an adjudication in my favour but Egg have failed to fully honour it and the FOS may be considering a fine on the bank now (still awaiting to hear on that). Thing is, while this dispute is rumbling on Egg can't pass the account to a DCA anyway and, even when/if they do, I will say I already have an AP with them which they are accepting - and then I'll complain again to the FOS and gridlock everything.

                        Its a minefield I am slowly negotiating and the last correspondance from CAP 1 was their DCA would be in touch as they were not dealing with my account but no DCA have been in touch
                        Monument did not tell me they were passing me on and I hate the letters out of the blue from DCA demanding money if only the OC would keep us informed what was happening all would be much more straightforward and then they wonder why we shout and cause a song and dance about it (only song I could thing of was BOB THE BUILDER can you fix it )

                          yeah I know what u mean. Egg tried to pass it onto Fredpricksons as well. I just ignored Freds and carried on paying Egg. lol, its a game. I think the best weapon we have is the right to dispute an account and refer to the FOS, this gridlocks things. You'll be able to find a multitude of grievances I'm sure if you send the lender a SAR.

                            Quick update
                            Received a letter or should i say 2 today from Circuit
                            the first one said thanks for your letter pay up
                            the second said we have accepted your DMP please send first payment
                            but I have still not heard from Monument I sent a letter stating without a NOA as per the EU directive (thanks Casper) they are obliged to still accept my payments
                            so still waiting for Monument to reply but have just paid them again direct no problems
                            So I assume its still ok to ignore Circuit

                              Yes ignore these idiots & report them to the OFT/trading standards if they refuse to get lost.
                              They have no legal power to any money off you whatsoever , only a court does and DCA's dont like going anywhere near courts as it costs them money to do so and wouldnt be worth their while in terms of what they'd get back, if anything at all.
