First post here - sorry if it is in the wrong place. I just wanted some general guidance on my situation.
Way back with my former wife I took up a 2nd charge on my property with FIRSTPLUS. Two years back I got divorced - Wife was granted the house, contents and any equity in the house. Legal ownership was transferred. I was ordered by the court to pay £1200 for the 1st and 2nd charge in lieu of the mortgage and 2nd charge payments. The 1st trigger event for sale was my daughters 18th birthday in June 2011.
In March 2011 I lost my job. I sought the advice of a solictor who states that in order to stop paying the order I would have to vary it - cost around £8000. He continues that the order is flawed in that it differs from what the judge ordered in that:
The spouse could apparently keep the house until death!
On the spouses death I have to make payments of £300 in spousal maintenance.
Obviously I had to go back to court - however needed to speak to my Ex. My Ex refused to respond to letters from the court and my solictor until a formal notice was "served" on her. OK sorry for the ramblings but this is what has happened.
Dealing with FirstPlus has been painful they do not give a stuff. I am financially seperate from my new partner and own nothing - no assets etc. I have a small service pension but less Child support and paymenst for council tax and household bills leaves me with around £200 per month. This I use to pay for a small life insurance - petrol (I have use of a car in order to search and commute for work). I could not afford offers made my FP ie %50 of there fee for 3 months only around £370 per month.
My former partner has somewhere to live (she lives with her new boyfriend). The house is on the market ... I have been angling for FP to start early repossession
They have placed arrears £2317 over to REDCASTLE / GOTHIA. I received a letter from them today. I have no intention of ringing them! as my partner had to change her phone last time due to calls every 2 hours. I am going to court on the 10th ... I will obvioulsy speak to my solictor and former spouse on this but as it is a joint debt do not want to be held holding the can for this.
Any suggestions on how to deal with REDCASTLE? I really do not want to offer them anything until I have been to court ... Sorry this post is so long but need advice on how to slow Gothia down. As the debt is a 2nd charge it is not I believe covered by CCA - The sale of the house would cover this and the mortgage but it may take a few months and clearly I am not in control of the sale.
