  • Lowells & my credit file

    I contacted them on their 0800 number (i was happy to) because of a letter sent by 3 to myself about a debt which i dispute.
    Anyway 1 guy put me through to another department - this other guy i got talking to had my credit file right in front of him and was telling me what was on it including defaults that other companies had put on it etc..
    To say i was fuming would be an understatement - they state that it was in 3's t&c's for my file to be obtained and they can do that now the debt has been transferred to them.

    This is pretty standard practice. If three pass a debt on to a DCA they usually have it written in the T&Cs when you took out the contract that this can happen for the purposes of debt collection. As your file has all of your history on it, they get that. Lowells use this as intimidation normally along the lines of "I see you have a good file, payments to XYZ and good credit. Would be a shame to ruin it" etc

    That being said, Lowells and Three are well known for mucking things up and chasing debts that dont exist

    Chef Stephen Yates was a customer of 3, but when his contract came to an end he moved to a different network and forgot all about 3. Two years later he received two unexpected letters, one from 3 and one from Lowell, a company he'd never heard of. Each letter stated that Lowell had purchased a debt of £211 that Stephen owed 3. The problem was, Stephen had no idea how he could owe the money, especially after all this time.
    My advice is to ring three up and find out exactly why there is a debt in the first place. Oh, and dont talk to lowells on the phone, they dont want to help they just want you to pay or admit liability to them. Keep it all in writing.

      Indeed.

      Even if it not true that some debt collectors get an orgasm or derive some other sort of cheap thrill from abusing people via the telephone, one should always remember that debt collectors tell lies.

        A DCA cannot touch your credit file unless they have bought it - they are not the Data Controller. I won a complaint to the ICO against Hillesden and Ruthbridge for this.

          Also if the debt has been sold. Both the original creditor and the new creditor (the debt buyer) have to inform you about the change of Data Controller!

            they are increasingly doing table 1 searches and debtors are having trouble getting these removed from their credit files. the ico and fos aren't interested. what were the facts of your complaint to the ico pinky? am interested to learn more.

                They do indeed...they did it to me for 333 quid, I challenged them,they sent various letters, I complained to OFT and after another letter saying they were not admitting fault but as a measure of goodwill would remove the default from my file....they did just that, plus any other info connecting themselves to me very quickly. .....unproffesional company
