    Hi Guys

    ok long story boiled down

    My husband and I are trying to sort out our credit files. (Laughs) anyway Fredrickson's placed a default on my husbands.
    I sent the prove it letters.First one got no response, second one did, but to add to my confusion it was from from a Mr Carter saying that they were no longer dealing with the account and it had been sent back to Pheonix recoveries. So can I now ask Brain Carter to remove the default seeing as its his company (fredrickson international) that put it there, or do I now need to start all over again with Pheonix UK? If so can Pheonix update a default?
    I have googled Pheonix and it seems that theres alot of confusion surrounding whether they have a UK licence or not???

    Any suggestions??

    Who was the original Creditor, before Fred and Bryan got involved? Did you actually default? If so, then on what grounds would you expect the default to be removed?

        Hi Unfortunately yes he went overdrawn , and they kept banging on charges daily and monthly that we just couldn't afford to pay. we did offer to bring the account back into the black but the origanal creditor HSBC were having non of it. We changed banks and stopped using them. Eventually I believe they sold the account on, we moved out of the country and its only now that we're back that we can access our files. The debt is only for around 500 but the default is for a silly amount of over 2 grand!!! We've no idea how many DCA's its been through as the default was placed by Freds, but they say their client is pheonix not HSBC

        So if Mr Carter is not longer in charge of the debt then he should no longer be able to have the default on my husbands file,it shouldbe under Pheonix?? Or removed?

          HSBC, would have applied the original default to your credit file.

          Was this for a Bank account;
          Credit Card or;
          Loan?

          What date was the account defaulted?

          Have you ever made a request to the credit reference agencies, for copy of your credit files?

          Credit Reference Agencies:
          Experian;
          Equifax and;
          Callcredit

            Yes it was for a bank account.
            We have got our credit files as we need a mortgage but its doubtful that we'll get one until we can sort the said files out.
            So if freds didn't place the default why are they named on it??

            I'm new to all this an find it really complicated,so thank you so much for your replies x

              Freds. took over as the data controller when the account was sold by HSBC.

              As per the Data Protection Act 1998, there can only be one data controller processing information about the account.

              When was the original default registered on the account with the CRA's?

                The default was placed in nov 2006. I have not heard anything from Pheonix. Should I contact them with the CCA request Orwriteback to freds and ask them to remove the default seeing as they are now saying that they are no longer in charge of the account?

                    Tried to ring...( I KNOW I KNOW bad decision) these clowns today...obviously they wouldn't tell me anything so got OH to ring them and give permission to speak to me...but they wouldn't disclose any info unless we confirmed his DOB...now do they need to ask for this??? I was unwilling to pass over any more information than needed to the phone call was very short. I'll write to them instead...but just niggled me that they wouldn't speak unless they had it!!!!

                      Under, the Data Protection Act 1998, they would need to obtain a written authorisation to communicate with a third party.

                      Never speak to a DCA on the telephone!
