    hi hope this was the right reply to send


    dear sir/madam

    i am writing to object to the interim charging order being made absolute as
    the claimants grounds for a charging order are incorrect.


    the claim that the judgment order made no provision for payment by installments
    is wrong as the judgment order was to pat £100 per month

    the claim that the judgment was for £2863.68 is incorrect as the judgment was for
    £2761.68
    please refer to the attached print out from the claimants own web page showing the
    debt to have started at £2761.68 and that a direct debit is in place to make the monthly payments

    i would also request that the interim charging order also be set aside as it is based on inacurate data and that all cost to date of this inacurate claim therefore be borne by the claimant

    i would also request that any further court action or hearings be held in the leeds or bradford areas

    thats a copy of the letter i am planning to post to the court and morgan solicitors in the morning

    Morgans / cabot done almost the same to me, i have a ccj instalments of £48.00 monthly, maintained payments, and still wanted a charging order.
    Anyway they sent all the documents for th charging order, which were incorrect by approximatly £3000.00
    With help off the forum, I made a witness statment, sending a copy to the court i defended myself, and a copy to morgans solicitors 10 days before the hearing, both recorder delivery
    Before the hearing morgans notified me that the charging ordertor will be withdrawn.
    At the hearing the judge informed me that no charging order would go ahead, his words where 'your witness statment has done the trick'.
    The judge then asked if i wanted to ask any questions, my reply was. ' as their are so many discrepancies with morgans documentation, would it be possible for me to have details of my accounts they hold.
    The judge agreed and ordered that morgans/cabot should supply a chronology of assignments from the inception of the accounts, 4 all ltogether.
    That was on the 22nd of march, not had any correspondance from morgans/cabot as yet.
    So fight them all the way.

        just got a letter from morgans they are droping the aplication for a charging order

            These DCA firms send out hundreds of applications for charging order(s): rule of thumb, in the DCA industry...
