  • please help with this ccj!!!

    hi there all,im new to the site and may i say its a god send!
    anyways back to my problem:
    2 years ago i gave a car back on hp(they said i could) that i had paid over 50% of the hp after deciding the repayments were too high and they then sent me a letter saying i owed them just short of £1000 in charges from the loan.
    i ignored the letter then a couple of weeks ago i got a letter from hilsden securities saying they had taken over the debt and were going to taake me to court if i didnt contact them to pay.
    i didnt,now i have a letter from northampton ccbc courts asking me to cough up £1226.73 icl court costs.
    what shall i do?
    pay it?dispute it as its all charges?
    any help would be greatly appreciated

    Now it has reached the stage of a court claim, you will need to defend the claim, if you intend to dispute the charges.

    It would have been a great deal easier to deal with had you acted sooner, but all is not lost.

    Since it is the CCBC that have written to you, presumably you have received a claim form and not merely a letter. When did you receive it?

      i recieved it this morning.it gives me the option of what to do...
      where do i stand if it charges only and not the actual debt,is it the same as a normal debt or can i barter down the price, if not idealally i would like to pay something like !10-15 pound a month.
      whats the best thing to do?

        As above, you are going to have to file a defence to the claim.

        If the claim is comprised of charges, you may be able to come up with a credible defence. Post up what you have been sent and in the meantime, file the Acknowledgment of Service in order to buy yourself more time.

          its a claim form asking me what i would like to do,eaither,complete the admission form,the admission and defence form if i part admit to the amount claimed,if i dispute the whole claim then its the defence form or the acknoledgement of service form if i more time to prepare for my defence.

            You need to acknowledge the claim, and tick the box where it says you intend to defend all. Once the claim is acknowledged then you will have an extra 14 days in which to prepare a defence.

            and can you post up the Particulars of Claim? You will find these on the front of the N1, o te left hand side about halfway down. Basically, this is what the claimant says you owe, and why. The basis for their claim against you.

              ok the particulars of claim says:the claimants claim against the defendants is for the amount due and unpaid as at todays date under a regulated loan agreement.
              the amount claimed is £1081.73
              court fee:£65.00
              solicitors cost:£80.00
              total amount :£1226.73

              so how would i defend myself?i really havent got a clue but im sure i could do something as all the money there asking for is in chages(late payments)

                        You are defending the charges part of the claim, so it depends on that amount.

                              thanks! thats what i wanted to hear! ill fill in the appropiate forms today.the only thing im worried about is will i need a solicitor?
