    Its time for an update...

    There is some fantastic advice/information on this forum post about how to approach a F & F settlement, and I really wish I'd discovered you people earlier.

    As it is I did what I had do a year or so ago and so I have to try and deal with things in the circumstances that I now find myself in.

    So I wrote to Cabot on 14th March and they replied on 16th March. I've appended copies of this exchange of correspondence (personal details removed) and I'd welcome any views you wonderfully sensible people have about what I should do next?

      It's a stalemate. You are arguing that your F&F was accepted because the cheque was banked. Cabot are arguing that the F&F was never accepted and you owe the outstanding balance. You are also arguing the account was in dispute and should never have been sold on. It is impossible to know how a court would look at it - whether they would accept that 2 weeks was an unaccepable delay in rejecting the settlement. You will soon find out if Cabot litigate, which they may do given the sum of money involved.

        I did exactly the same in the mid-nineties to several accounts. Nobody chased me apart from a few desperate follow up letters that all received the same cursory response from me i.e. you cashed it, you agreed, take to the county court if you want. Never paid any of them another penny.

        Hope the same works out for you.

          Litigation would be interesting.

          You will note that their "final response" letter conveniently ignores my comments about them acquiring a debt which was clearly in dispute.

          The previous DCA, Clarity (who were the ones who banked the payment) threatened legal action but didn't proceed and Cabot acquired this debt in October of last year haven't yet gone "formal" on me.

          I geuss I will just have to sit on my hands and wait for something to happen. My frustration remains that they remain unwilling to do anything about the registered default.

            The only propblem is is that companies such as Cabt have a department that deals with corrospondance so the time frame between it being uploaded then responded too can take a while if you contact them say that you can pay 10% and then they will come back with a figure and keep negotiating down to the figure you want. Clarity are fairly covered with what they have done but Cabot have bought the account so they do technically own the default on your credit file as well. Cabot update credit files as fully satisfied even with discount so even if you cleared part of the balance with clarity it would only be partiate satisfied where cabot update as fully satisfied win win situation!!!

                Hiya,

                I'm pretty much where I was with them to be honest. A stalemate.

                I have made a complaint to the FSA (and Cabot are aware) but that's gone very quiet - its ben a few months now since I've had anything more than an acknowldgement that they are "investigating" my complaint.

                Cabot still refuse to remove the default from my credit file, but equally they're not hounding me for the alleged debt either.

                So as I say, pretty much a stalemate.

                  RM|: you can always write them a Dear John letter and state "it (DN record) gets removed as its inaccurate, and if not then you'll issue a claim for xx pounds as they are clearly trying to damage your credit rating" I've read this thread and the DN is understandebly a major scab on your person that needs to be addressed and closed somehow.

                    Happy New Year to everyone.

                    Its been a while since I updated this thread with any developments so I thought now might be a good time.

                    I lodged a complaint with the FOS about Cabot's behavious which after alot of discussion and deliberation was NOT upheld on the basis that Cabot did not have any idea that the debt they had acquired was disputed.

                    However, if you follow that logic, (which pleasingly the FOS has), there are justifiable grounds for a complaint to be levied against CitiFinancial for selling a debt clearly in dispute.

                    The FOS wrote to Citi in early November and the eight week period has elapsed. However I also wrote to Citi who deny ever receiving anything from the FOS, so I've subsequently sent copies of everything I think they'll need and the eight week clock is ticking again.

                    Anyway, I'm sure Citi aren't just going to say, "whoops!, your quite right and we're sorry about all of this", but nonetheless it will be interesting to see what they do finally have to say.

                    Anyway, thought I'd keep everyone in the loop and irrespective of anything that happens with this I'm certainly not intending to pay anyone anything without them having a Court Order, which for some reason no one seems to want (yet) to start the balling rolling :tinysmile_grin_t:
