    Hi all, i need some help on a car finance issue me and my partner are dealing with at the moment and just dont know what to do, so any help and advice would be greatly appriciated.

    My partner purchased a car in dec 07 on finance with the blackhorse, he made his regular payments on time and without fail, unfortunately we hit some bad time and my parnter was laid off from work during the hard financial time, he contacted blackhorse straight away and explained the situation, he was informed to make a payment of as much as he could and then contact them when he returned to work, over about 18 months my partner went in and out of work but he always paid what he could and kept blackhorse constantly up to date with the sistuation, in oct 2009 my partner was able to get full time employment and has been in it ever since, he told blackhorse this who said to him pay £200 per month, that would cover the car payment and £30 off the arrears that had built up, we heard no more and have paid the payments over the year that they had asked for, .. until now!!.... a company called CREDIT STYLE... sent us a letter saying we had to contact them and sort out our arrears with blackhorse, my partner immediately contacted them and told them he had been paing off his arrears and that blackhorse were aware of the situation, they then informed us that we had an outstanding arrears balance of over £2000??????? where had all our money gone?????? Credit style then informed us that as we made payments of £200 blackhorse added interest of £206 per month as we were in arrears!!!!!......a man came out to our house from credit style who gave the impression that he wasnt bothered about our situation and got on the phone to some woman who informed my partner he would have to make 12 monthly payments of £400 to keep the car or fill in a form giving up the car voulantry??......and was told we had 48 hours to think about what we wanted to do????.....this was 3 weeks ago and we have not heard from them?...as we dont know what our legal postion is we have just been trying to purchase a cheap second hand car so that we can give the car back.....but the more i think about how we have been treated the more angry i become, so this is why im here today to see if anyone can help with this awful situation...... one thing....the car is registered to me ....does this make a difference in where we stand??? thank you

    Hi there

    Thanks for posting up and I'm sure someone who knows how these issues work will post up with some help.

    I take it there was no insurance taken out with this product then?

    If in difficulties, I think it would be best to keep everything in writing, rather than just speaking to them over the phone.
    You then have something to fall back on if you need to refer back to this again at some point, for example - complain to the Financial Ombudsman Service (FOS).

    Do you still have the policy details on this purchase?
    If not then ask they provide them to you in the post.

    Meanwhile hopefully you will get some advice on how to deal with this soon, good luck.

      I will have to look over the paperwork im sure to have something somewhere.....also one thing i missed out on my post was that we have asked for a full statement of our account which the man that came to our house said he could provide still has not appeared?....all we have received since is another form for voulantry giving up the car

        Chase them up on this, tell him you still not received the full statement of the account and you require this.

          Is the credit agreement for hire purchase? If so, depending on how much you have paid, it might be difficult for the lender to recover the car without your co-operation.

            If this is a HP (hire purchase) Agreement then....

            You can VT (volutarily terminate the agreement ) and hand back the car with no further liability if you have paid half of the original agreement , and any arrears

            If you have paid over 1/3rd of the agreement they can not take back the car unless they get a court order.

            you need a copy of the original agreement and a statement of the account so that you can check these details
