Im pulling my hair out here!...Aktiv Kapital just put a default notice on my account and stopped me getting a mortgage!
In October I applied for a mortgage with Halifax, was approved with flying colours on my credit score. Didnt find a house so started looking earnestly again after xmas. Found one last week.
Applied for a new mortgage offer as pervious expired after 3 months and was declined.
On checkling my credit Aktiv Kapital have put a default notice on my account for a debt from 2006.
First, the background:
Back in 2006 I had a business go bad, (through no fault of my own just for the record!) but with a number of creditors requiring money I sold my property and used the equity to pay them all off a percentage of the debt.
All agreed. However one agreed (TSB cc) only verbally, my first mistake!
Lloyds TSB I owed around 6K. I sent them a cheque same as all the others (around 6 debtors in total) and after advice wrote on the back on the cheque (for full and final payment, the amount and acc no)
In 2006/2007, after I settled, they continued pursuing me for money. Stating they had not agreed to full and final settlement.
In 2007 they passed to DCA and in June 2006 put a default notice on my credit card account.
Now, some 4 years later, they have put a default notice on my account and now I cant but a dream house id saved 2 years deposit for.
They sent me a letter but I threw it away because i figured it was a mistake.
Whats my best course of action, ideally id like the default removed?
A) Is giving me a default notice on debt more than once allowed? Even from different companies but on the same account?
B) Can they still chase debt from 4 years ago?
C) I considered just paying it to get the mortgage but I understand that would be just as bad as id be admitting the default?
D) Who can I go to for help, the citizens advice beaurea, get Equifax to update their records with a notice of correction?
Any suggestions greatly recieved!
