    I have read similar threads but still a little confused as to which letter to send in this particular instance ........ the story so far ...........

    A friend has just told me that she has been receiving telephone calls and letters from Aktiv Kapital for the last few months.
    The correspondence is all in her maiden name (she married 12 years ago!!!) but sent to her latest address.
    Aktiv say it is a Halifax CC debt ....... my friend did have a Halifax card many many years ago but can not remember if she had a debt on it or not.

    She has so far refused to speak to Aktiv on the telephone and they are now threatening the doorstep visit plus their "solicitor" has now sent her a letter. (The usual scenario).

    I am putting a letter together for her to send to Aktiv and adding no telephone calls, all in writing, refuse doorstep appointment etc etc.

    But as she has had absolutely no contact regarding this account with Halifax (or any company) for well over six years shall I base it on the Statute Barred letter or on the prove this agreement exists CCA type letter?

    Base it off a Prove It for now. (Post#4 first link in my siggie)
    No need to get all heavy with a CCA and the simple approach can often glean the best results.

      Thank you for quick reply ........ all understood ........ just one more question.

      Might sound strange but ........ does my friend reply using her married name? (Making sure any signature she does is copy/paste proof of course.)

        I'd be inclined to use the name they addressed the letter in.
        Of course don't sign it, a simple handwriting font will do the trick

          Hello again,

          My friend has now given me the letters and the second is not from solicitors of Aktiv but from Buchanan Clark and Wells DCA.

          Shall I send prove it letter direct to Aktiv or BCW?

              Oh Right!!

              Obviously you have had dealings with BCW before?

              So for now I will advise my friend to sit tight and await next letter.

                Remember one DCA making demands for yet another DCA can be freely IGNORED as they have ZERO legal powers at all

                  Update

                  Friend received another letter from Buchanan Clark and Wells DCA ....... they are sorry to see no payment has been made (no contact has been made either!!!!) but as a special offer my friend can settle in full in the next seven days by only paying 25% of the balance.

                  What an offer on a debt that by BCW's own admission is 17 years old and that my friend thinks the last contact was made approx eleven years ago!!

                  Does she still ignore for the time being?

                    Their offer is no where near the right figure..

                    If the debt is that old then why waste your time or a stamp responding.
