    Hi all
    New to this forum but here goes debt with Capital One tried to negotiate a DMP got no where in nearly a year passed to credit solutions who still would not accept my offer threatened with court action doorstep collections etc complained to FOS who took on my case but sided with Capital One even though I had paid all my pro rata offers do I now have to go back to credit solutions and try to negotiate again or wait for the bully boys to get in touch

      How much do you owe? When did you last pay anything? When you say the debt was "passed to" Credit Solutions, did Credit Solutions actually buy it, or are they acting as agenets for Capital One (you can normally tell by the wording - if acting on behalf of, they tend to use the words our client).

      Try sending off either a Prove It letter or a CCA request to see if they can back up their right to collect on tis debt. Have you received a NOA?

        Thanks for the replies its says they are acting as agents so I think they may just be collecting so should I pay Capital One instead

        Tell its xmas I owe £4200 and last paid in October 2010 thats when FOS put a hold on the account until they investigated

          If acting as agents you're best doing one of two things. One (my preferred personal initial route and recommended on this site) send the DCA a Prove It letter http://www.legalbeagles.info/forums/showthread.php?t=9119

          Secondly, if you do pay anything do it via Capital One's online payment procedure - otherwise they may well refuse your payment.

            Hi All, I'm new to Leagal Beagles as well, but in this case may be able to give some pointers.

            I have recently married my soul mate..... In fact we met in Oct 09 and were married in June 10. She has some quite bad debts, which, as a team we are working through. The first step was to consider bankruptcy which is fairly drastic, so we looked for alternatives. We ended up looking at an IVA and using Payplan as an intermedery, this has been highly successful for us. Because I am disabled we are waiting for some benefits to be finalised so we aren't in a position to show our total incomings as yet, however, Payplan have helped us with a DMP in the intrim (one of the creditors is Capitol One) low and behold, since we handed everything over to them the phone calls have stopped and the nasty letters are no more. Once we have a complete picture of our incomings they will then look into moving to an IVA. In our case Payplan have been a god send it's a completely free service, their staff have been helpful, understanding, proffesional and importantly non-judgemental. The point is, don't try to sort debt issues on your own, don't ever pay for debt advice and don't use a company that has been reccomended by one of your creditors. It takes a little research, but in our case it's paid dividends.

              Hi there
              Thanks for your advice I have managed to sort my own DMP with a little help from National Debt Line the only one I have had probs with though is CAP 1
              Got another thread running under credit cards telling my woes
