    0844 anything up to 8p a minute, beware though of 0843 etc numbers.

        A load of utter drivel by the empty heads at Motormouth Finance. I bet their so called numerous attempts consisted of slimy Shane telling you he was on his way to visit you unless you phoned his telephone threat monkeys. What a loser

          unfortunately the first i knew of anything was an email from them basicaly demanding money.no letters ,no phone calls just a lonely email. i ignored and then the letters started coming through the door threatening to come round to my house with emails of the same nature to match.

          what a bunch of cowboys.

            That is a completely disgraceful letter.

            1) For a start 7 days is not adequate time to give you before initiating court proceedings. Most solicitors now advising at least 21 days.

            2) Note they say they MAY apply for a CCJ

            3) They make the presumption that they WILL get a CCJ

            4) The letter is written to give the impression that once a CCJ is obtained it will result in instructing bailiffs or an AOE which is completely incorrect (this can only be done should the CCJ not be paid). Point to note though, creditors now have been given the green light to apply straight for a charging order at the same time as getting a CCJ, as opposed to a debtor defaulting on the CCJ. Will be interesting to see when this starts appearing on template letters

            5) As for the threat of an 'Oral Examination' and being sent to prison - that it outrageous!

            I would consider sending a copy of that letter to the OFT and making a formal complaint. Its in breach of OFT guidelines on many levels!

                  hi crispy ,thanks for the reply


                  the debt is for a payday loan that i couldn't keep the repayments up when i lost my job. i can now afford to pay it back but i refuse to jump through their hoops because of the way this has been handled. it got to the stage where my partner was worried that they would show up when i was at work and gain entry to the house, i explained the reasons why they had no right to gain entry but it still caused worry for her.

                  cut a long story short i angrily(and stupidly) fired of an email explaining to them that i was in a debt management plan (which i am) and if they could give me more details of the debt then they would be contacted. after a few days i received an email stating they had not been contacted by my DMP and would be taking further action (they must have missed the part where i said more details etc..). anyway i have stood my ground and i refuse to budge.

                  i have requested a copy of the original and signed agreement.
                  a statement of account,
                  proof of who owns the debt and
                  a copy of their complaints procedure.

                  i have received none of the above.

                  i have also explained to them that they are not welcome on my property.

                  they may be in the hope that i will not turn up at court if it goes that far but i honestly hope it does so i can show the judge how this has been handled by them. the threat of jail etc is disgusting and i will be making a complaint to the OFT and anyone else who will lend an ear. they cant get away with stuff like this.

                      Silly question but are Motormouth licensed?????????????? I cannot see anything on there letterhead or there website.

                      If there not licensed are they not acting illegally??????

                            I was even threatened to be beaten when they catch me... the thing was, that I did not even had a debt. Somehow sorted it out at the end. But all debt collectors are nasty pieces of work. I know they do their job,but some times they should be a bit more considering.

                                How much would I love someone in Motormouth to threaten to beat me up. They could be certain of one thing that I would prosecute them to the full extent of the law. Then again they would have to speak to me in the first place. I have no intention whatsoever of speaking to them. Lol.
