    Hi, here's my 1st post, hope I make sense.
    My partner has had several loans with welcome finance dating back to 2003/04, think the last one was taken out 2007/08 (can't find any paper work as yet).
    All going well, loan getting paid, but then changes within jobs and circumstances there £60 per week was too much, agreed with local office in Cumbria to reduce, they wanted £60 per month. Perfect. £14.50 direct debit from bank acc every Friday for a good 2 year. BUT... office now gone from Town and account been passed to Preston Office. THEY WILL NOT LEAVE US ALONE. They are harrasing with phone calls etc everyday. Preston is a good 100 miles away from where we live or i'd think they'd be knocking. I have authority to speak on partners behalf (i'm better with bills each week, partner a bit weak!
    I've had one girl pracically telling me we are millionaires and if we don't send 3 months wage slips and bank statements they will take legal action. We are being honest that we cannot pay anymore as we have other debts and my partner works away which costs us £200 a week plus, plus i got our rent and household bills to pay -my priority to keep a home for us and our 3 year old girl.
    Her calls are beyond reason, the other day i was in Morrisons, she called, I agreed I could talk but 30 mins later she was being a right cocky madam. Yes we have debt, unfortunetely, circumstances change. I told her not to snap at everything I was saying, and said that I was 5.5 months pregnant and she was stressing me out. Her reply was "extending your family is not right when you can't afford your debts". END OF CALL. How awful, what a thing to say. Only wish it'd been recorded call!!!!
    She said she is in her rights to ask for documents and that we were hiding stuff from her to stop us paying more. I feel like cancelling DD and giving her nothing and changing our numbers!
    SO a few things.... Can they demand wage slips and bank stmts?
    Can someone help me do a letter asking for original agreement?
    I'm sure PPi is included? Is it worth claiming?
    I've asked them not to call and put her opinions/querys in writing. Refused, is it worth writing to head office? I've told this girl, they are no more important than any other creditor but she seems to think she has the courts and law on her side. I invitied her to take him to court and it would be much easier, but she doesn't want legal action!? Wonder why!
    Please help. This is the only creditor I feel is being unfair, unwise, ridiculous and very unsympathetic with infantile attitude! HELP!!!

    An agreement is already in place, even if you dont have it in writing the fact that it has been active for 2 years is evidence enough, personally I would refer them to the proposed reply given in Arkell v Pressdram (1971)

    You ask for help with a letter, below is something you may wish to consider, but knowledge is power so I also suggest you familiarise yourself with -

    Protection against harassment Act http://www.legislation.gov.uk/ukpga/1997/40

    Guidance on debt collection issued by Office of Fair trading http://www.oft.gov.uk/shared_oft/bus...dit/oft664.pdf

    Does your telephone not allow you to bar incoming calls from their number? if not, it is your phone and you can decide who you speak, either do not answer it or hang up if they give the big attitude.

    The PPI was missold if you did not want it, ask for it, or you did not understand what it was, in which case you can claim it back.

    One more thing to note, Whilst you keep making the smaller payments you are effectively extending the period of the loan(s) which of course increases the amount of interest you will pay, so it is in your own interest to repay as much as you can.

    This is a Subject Access Request made under section 7 of the Data Protection Act 1988.

    Please forward all Data you hold in respect of [name & Address] and Agreement numbers xxxxxx, xxxxxxx

    This should include, but not limited to (for each agreement) -

    Copies of All agreements

    Full statements containing all transactions from the conception of all accounts

    Details of any charges added to the account.

    Copies of all account notes.

    Details of any manual interventions.

    Copies of any Data shared with or provided to 3rd parties which contain my personal or financial information, including underwriters, insurers and credit reference agencies

    I enclose the Statutory maximum fee of £10 and look forward to your response within the time limit of 40 days

    Whilst writing, I have recently been subjected to unreasonable pressure from your Preston office attempting to demand more than an agreement which has been in place since 2008. I advise you I am aware of the OFT Guidance on debt collection and the Protection Against harassment Act and will not hesitate to use those provisions where and when necessary.
