    Re: Robinson Way Help Please!

Purely as a delaying tactic and just to be awkward, should I question the fact that I have never been informed that this debt has been passed on to a DCA?

      No need for now.
Time to play hard ball with them, but keep that thought in mind.
Assignment, or lack there of, is an excellent defence strategy..

        Re: Robinson Way Help Please!

        Just a quick update Ben...

I ave sent a letter as suggested, but having looked at the statements, I don't think the £20 I paid did clear the original overdrawn amount. I misread the overdraft as being £1.65, whereas that was the amount I had in the account when Paypal attempted to take a payment of £38.

I have therefore offered to pay the difference between the outstanding overdrawn amount plus one set of charges for the indiscretion minus the £20 I had already paid.

I'll let you know their response.

        Again thanks for your help.

Your choice really, but as the vast bulk is charges I wouldn't of even offered to pay ONE of them. Your account was POSITIVE for 1.65 until they hit it with a large charge for a bounced DD.

Looks like you had a charge of £38 for the paypal payment of 28.80 from a previous month

So basically you are offering them a further 20 (ish) to conclude this matter ?

I do note it took them 6 months before doing a DN and this spiral of charges has continued for about a YEAR !!!
The whole thing is a farce, TBH.

            A kind of update...

I received the attached letter today, but it must have crossed over with the letter I sent as posted a few days ago.

My question is, should I respond to this letter or just leave it until they respond to my later inviting them to take me to court?

            Again, any help much appreciated.

            Thanks

            Arkie

File it and if they do turn up simply state that you will ONLY deal with this matter in writing.

                    Re: Robinson Way Help Please!

Having sent a letter offering to pay back the original overdrawn amount plus one penalty charge for my transgression, I today received the following letter.

I had made it quite clear in my last letter that I was not willing to negotiate and that I would be happy for them to take me to court.

Advice on next step much appreciated

                        Re: Robinson Way Help Please!

Ok... Don't want to come across as sounding ungrateful, but I've followed all the advice given to me so far but now I'm in the thick of it, it feels a bit like 'You're on your own now son' for some reason...

If no one knows what I should do next, that's fine, but if you could just say so then I can try and find some advice elsewhere.

                        Many thanks

                          Re: Robinson Way Help Please!

Sorry buddy, only just seen this.

TBH, you have told them the situation and I would leave it at that.
As previously mentioned this "debt" is the result of snow balled charges and as such completely unfair and, potentially, unenforceable, especially with the OFT views on this matter and UTCCR s5.

So all in all file RW&c latest missive as it's simply a cruddy templated response.

                            Thanks for the reply Ben...

I'll do nothing at this stage then and wait to see what their next move is.

Someone suggested sending a 'no trespass' letter after they suggested they may visit in an earlier letter. Is this worth doing?

                            Regards

                              Re: Robinson Way Help Please!

I never really bothered with that TBH.
If they arrive, which I doubt, simply inform the agent that you do not discuss financial matters in this manner and everything must be in writing, bit like phone calls really.

At the end of the day, RW&c know they are onto a looser here, hence the template responses.
                              They'll crawl away soon enough.
