          Did you send them a simple Prove It or an actual CCA request ??


          Either way they haven't demonstrated their lawful rights to make demands on this debt.

            I sent them a simple prove it as per your advice Ben.

                      When it first came to light with the original DCA I went to the Nat West to find out what was going on as I genuinely didn't know what the debt was for.

                      When they explained I told them I couldn't afford to pay the debt in one go, but was willing to pay £20 a month. They took £20 from me straight away, but when I tried to make a second payment at the bank, they told me they couldn't accept it as the debt had been passed on to a DCA.

                      Being completely ignorant of the workings of DCA's etc, I just assumed they were telling me the truth. I then never heard anything else from the original DCA.

                            Well as promised I'm back.

                            Here's my thought.
                            The £20 payment actually more than cleared any lawful debt that you owed, whatever is left is clearly multiple charges and associated interested.
                            I would be inclined to explain this to RW&c and suggest if they want to enforce this "debt" that they should meet you in court and let a judge decide on the legitimacy of their claim.

                            The OFT takes a very dim view on the spiral of charges that artificially inflate a debt in this manner and I'm sure a court would take the same view.

                            So all in all a simple matter of telling RW&c to naff orf or take you to court.

                                They may well come back with some rubbish concerning the OFT Vs The Banks test case, but this bears little relevance in this matter.

                                The Supreme court did NOT slam the door in the reclaimers faces, but meant things had to be dealt with at a more personal level.

                                What has happened in your case is clearly unfair as the banks charging regime has snowballed into an unmanageable debt.

                                Also why have they not attempted to contact you about this previously ?!
