    Hi,

    No I haven't contacted them. I didn't know this. I will look into this now.

    Just so you know, I've just contacted ICO and they have said that I need to contact the Office of Fair Trading Act...
    So will try them now.

        Just contact OFT, and they were no help at all. They kep saying that I should SPEAK to the DCA and ask them about the CCA and also about freezing the interest.

        Why would anyone want to speak to a DCA? Thats crazy.....

        They also said that the DCA CAN charge interst on the debt...

        I'm getting worried now as they didn't seem very helpful at all. :tinysmile_cry_t:

          Hiya, sorry they were not any help to you.

          You can still request they freeze the interest, if your in hardship your entitled to do this, then if they don't go to the FOS as stated, and ask if they will consider looking at your case under hardship, with your reasons.

          I agree, not to verbally talk to the DCA, if anything you do this in writing.

          You can always let the fos know they did not enclose you with your CCA too.


          And continue to pay the planned payments, but don't let them hassle you while your complaint is in dispute (such as if its with the FOS).
          If in dispute you can put it on hold, but I would continue to make the arranged payment plan.

          Do not worry, I know its easier said than done, but you will get there. X

          PS, I taken mine to the FOS at the time, because the company ignored my requests and time went on and the debt was just getting higher, if the fos upholds in your favour - after you trying, then they will I expect do the same for you as they did with mine, such as backdate to the date you first requested, and some cases from the time you went into hardship.

            Thankyou so much,

            I feel better after reading this. Yes I will make the payments of £1 starting 1st Nov and will wait and see if they do give me the CCA which is due by 19/20th Oct.

            Will be sending I/E and request for interest to be frozen on Monday 18th, will keep you all posted.

            Thankyou all for such sound advice, much better than CCCS, Lol!

                Ok, just read your extra little bit. What happens if I start working again? of course I will still make the £1. But, would the FOS or the DCA be able to find out if I started working?

                  When you start work, let them know, but it takes time to get everything back on track, at the end of the day your in hardship "now", this is why your asking for help from the company.

                  Once your back on track then alternative arrangements could be made, depending on your income and outgoings again, as this would have to be updated, it all depends on that as well, but you can only afford what you can only afford.

                  For example, maybe you could make arrangements of say £40 a month or less, depending on your financial outlook at the time.

                  Hope this helps X

                  Also it could be the fact of having to continue to pay the £1 a month even whilst you start work - for a little while...........

                    Yes that does help, but surely if you ar paying £1 a month and stick to it, they can't do anything? My aim, is once I do start work to save then offer a F & F when I'm in a better financial situation.

                      Sorry just added more to my above post again lol.
                      But yes if that is the perm arrangement, that will be fine, or up to the point of them asking for a review, they may do this or they may not.

                          To get a lump sum together when you start getting back on your feet is also a good idea on the arrangement of F & F.
