  • Advice needed please!

    Two letters just come through my door. Same question with each - what should I do now?

    1.From ScotCall Debt Collecting Services, Glasgow for £470.19. This has already been through two DCA's who I have got rid of. Should I file under "I" or write asking for original CCA as I'm pretty sure they wouldn't have it - debt in dispute - go away!

    2.Philips Specialist Bailiff and Debt Recoverry Agents, Darlington for £4286.86 defaulted about 2 1/2 years ago. Been through lots of DCA's who I've totally ignored (up till recently was burying my head in the sand). Original loan was owed to Barclaycard Motor Loans. This letter states the debt remains outstanding to BCW Group PLC - Consumer BCW, so I assume Barclaycard Motor Loans have sold it? Got credit report dated October 6th and nearesrt I can find on there is Aktiv Capital for £4265, nothing about BCW Group on credit report at all. Threatening further recovery procedures so not too bad at moment, should I ignore or do something?

    Any advice much appreciated as always,

    2. Nice posh letters and I bet they are collecting for another DCA File again..

    A DCA collecting for yet another DCA has ZERO legal powers. Yes they may demand payment, but that's all they can do.

      Hiya Ben,

      Received another letter today. Sent Prove It on Nov 3rd, they've totally ignored that and Philips say I've ignored their request for payment, arrears being allocated to Enforcement Bailiffs or Recovery Agents who'll come and take my goods. Obviously I realise this is crap, but what is the next step. In the prove it letter I asked for no further contact to be made unless they could prove my liability and threatened to complain to Trading Standards and OFT if they ignored my request.

      Two questions:
      1. Do I communicate with Philips in any way whatsoever?
      2. Do I complain to Trading Standards and OFT? If so my local one or theirs up in Darlington?

          Just send them a letter saying that until they come up with proof of the alleged debt you won't be paying them anything. I'm sure you'll be able to find something suitable on one if my threads somewhere. Throw in a bit about OFT 664 if you like too. Do you intend to pay this debt? If so then you need to get it returned to the OC and possibly negotiate a F and F or a decent instalment plan.

              I would, but I had to be talked step by step through getting it there at all - how do you change the resolution? Idiots guide needed please!
