    Re: First Episode

    Hi Curlyben

    Thanks for your kind attention!

I intend to issue proceedings next week, but my big concern is time limitation!

I received the SAR last August, and for most of the time since, I have been in correspondence with the opposition's solicitor.

In this connection, am I out of time to issue proceedings?

      Hi,

If this debt collector does not have a CCJ, how can the debt be assigned to this debt collector?

there doesn't need to be a CCJ for a debt to be assigned.
A debt is a choose in action and as such assignable at any point, even while active.

            Hi Curlyben

Forgive my ignorance in such matters.

If this dca does not hold a Judgment, the dca cannot enforce a Judgment because they have not got a Judgment - am I correct?

If the OC did not pass a true copy of a Judgment to the dca, and the alleged debt has lain dormant for some 17 years, then the matter is statute barred - am I correct?

The debt collector commenced enforcement in 2007, in this case, what could have been assigned?

Say that I wanted to have the Judgment set aside, I could not do that because no one has a copy!

Help me, as I am perplexed.

            Regards

            M.
