        any more news on here about HFO
        first question,
        1 / do you have any letters from HFO CAPITAL / SERVICES which one
        have you sent a CCA REQUEST to HFO
        have HFO supplied you with a payment schedule
        have HFO sent you a notice of assignment if so can you post it up here removeing all ID
        have they been harrassing you by Phone if so in future you need to write a letter to them that contact only by mail harrassment letter should be on the forum

          If it's HFO, there's always cause for complaint. Even by DCA standards, they're an unpleasant and nasty bunch.

          How they're still allowed to trade never ceases to amaze me, but then that could apply to any DCA.

            Hi all,

            Update on HFO, they have sent me a notice of 72 hr litigation letter and added details of what to do about a ccj! Shall I now send my letter ' prove it'?

              I would say yes - send your prove it letter. Use the example template letter in Curlyben's DCA thread.

                  I have been seriously unwell with cancer and have not contacted HFO with a letter about this debt. Apparently, they are still contacting me at work so, I have been told. I have just finished my treatment and seriously need to focus and sort this debt out. I am so sorry to be asking for advice again but need to sort out what letter I should be sending to HFO about them contacting work and to prove the debt.

                      Have you told them how ill you are? If you have not, then I think you should as their harassment of you contravenes the OFT guidelines on debt collection. If I were you, I would amalgamate this information into your harassment letter and copy it to the OFT.

                        Sprout. I am so sorry to hear of your difficulties. You're in good hands here.

                        Try sending them a letter like the attached, which is an adaptation of one of Casper's letters he kindly sent me (acknowledging material!). You will see that the idea is to get them to abandon the debt. Or perhaps some of it, and to get them to accept a token payment while you are ill.

                        I write to inform you of a change to my circumstances and as such I am unable to maintain the present level of repayments.

                        I am seriously ill with cancer and have been receiving a series of treatment including XYZ on 123.

                        I am now struggling to cope dealing with any financial matters and my illness is exacerbated by the constant stream of demand letters coming through my letter box each day. I have been diagnosed by XYZ at ABC Hospital (proof can be provided from my consultant should you wish to see it). Sadly I am now unable to work at all.

                        Please find enclosed an updated Income and Expenditure sheet detailing my current financial circumstances. As is apparent, our outgoings far outweigh our income and as such I am experiencing extreme financial hardship.

                        Your conduct, bearing in mind the industry-wide guidance for people like myself, has been nothing short of appalling and the letters and phone calls I been receiving recently could amount to criminal behaviour. I have, as you know, recordings of all these conversations and copies of all correspondence since XYZ.

                        I would like to assure you once again that it was never my intention to renege on my financial responsibilities but unfortunately my circumstances are such now that realistically I cannot maintain payments of any kind.

                        I would therefore like formally to instruct you that payments of any kind are now going to be stopped. I would like you to consider the contents of this letter carefully and would ask that you write this debt off given the gross misconduct by yourselves and your supposed legal experts. Alternatively, having taken legal advice, I have been advised to ask you that if you are unwilling to write the debt off and confirm this in writing to myself, if you would please initiate proceedings to make me bankrupt as soon as possible.

                        I would greatly appreciate any help you can give me and look forward to your decision regarding this account. After eight years of apparent stalemate, it needs resolving once and for all.

                            I don't think you should be providing your income and expenditure details to a debt collector, it is absolutely none of their business.

                              Amy that's not anything that's ever bothered me too much, personally, as they can then see there is bugger all to go after. But agreed, there is no requirement to send an i/e sheet, so Sprout can just edit that out of any similar letter to the above he sends them.

                              Oh, and Sprout, you can also edit out the bankruptcy threat as well (unless you feel differently. It was obviosuly a tactic Casper used to effect but imo you should aim to send whoever owns the debt and/or is pursuing the debt a letter "similar" to this one, adapted to meet your particular circumstances).
