    3uk have today admitted that Lowell have posted a default to my credit file for the wrong amount and it should be for a lesser amount.

    They also say the default was sent to an address that i have not been registered at and it was my responsibility to tell them of my new address....

    They also admit that they sold the debt to Lowell and therefore they have the right to post a default on my file....as I now owe the money to Lowell.

    Help How can I get this default removed I have never had any dealings with Lowell nor am I in a contract with 3g....

    I know I need to write to the ICO complaints dept I have spoken to them on the phone and they are very aware of Lowell's

    If you do not want to contact Lowell you can write to the credit reference agencies with proof the default amount is inaccurate. They are joint data controllers with Lowell and default entries must be both lawful and accurate. If they entries are not accurate, the CRAs must remove them. If they don't, you can then complain to the ICO.

      update response from 3G.. I have written to CEO Mr Russell...however from reading between the lines...it looks like he just passes correspondance onto Exec Office.

      I did not rec any correspondance from 3G due to the fact the address they had on file I left in 2006

        If Lowells formally have control of the entry on the credit reference files, then it is their responsibility to correct any misleading/incorrect information.

        It seems that 3G have sent corrections to Lowell? Or they claim they have?

        If so then you need to write to Lowell and demand that they correct the misleading data they are reporting on your file.

        You can dispute through the CRA instead (or as well), but if Lowells reply to them that the data is correct, then the CRA will normally refuse to amend anything. Arguably that is wrong, but they are awkward barstewards and will pass the buck if they can. If Lowell correct things from their end, then job done.
