Hi just need some advice, I recevied a letter a few months back from hfo stating I owed £1800, they said it was from welcome finance .Did have something back in 2005 with welcome and lost job etc so couldnt make payments . cca'd hfo and they sent me back a one sided document with no terms & conditions (even though these were refered to on document) and what was included on document was illegible. Sent them another letter stating wanted full legible agreement. Have received letter from turnbull rutherford their solicitors statig litigation will begin in 14 days . Just a couple of questions has anyone any suggestions for a letter I can send back to turnbull rutherford? also hfo havent sent me any statements to state how this amount is reached, (have entired an amount recently on my credit file that is £600 lower than the figure they are asking for) .
is it up to hfo to send me statements of account ( as they are adding interest) and also a notice of assignment or do I need to request these myself?

    sorry bit long winded

    thanx

thanks will keep an eye on it see if anything developes...i have had notification from THE FOS and Barclay's Bank /goldfish/Morgan Stanley have agreed and wiped the bill clean and prommised to remove all adverse defaults...but this isnt over as i intend to continue my case against HFO due to the fact that it was an illegal default as they had no rights to title of the contract and it has cost my wife 1500 upto now in guilt by association which the ICO AND FSA have published a report stating this should not happen we have written proof from our bank that it did happen and she was refused a consolidation loan because of the adverse credit we are also bringing into the dispute experian as they refused on countless occasions to investigate the claim by HFO and the subject to access request identifies Mr Alisdair as the culprit so we have subject to access Eperian and all data on the audit trail points to Experians negligence and refusal to look deeper thsi is also the email data and we have demanded all e mails concerning the account the FSA and ICO are now saying they will instruct them to supply the e mails...as i have here diane and alisdairs signatures so experian have no excuse ..i will not let this go particularly for the simple reason they asked me to put my wife on the game to pay the bill ggggrrr i wanna see the whites of alisdairs eyes in person...

Wrong defaults can cost the company that put them there dearly. It can be read as defamation.

                    Re: hfo/turnbull rutherford

Has is been established whether or not the "agreement" they sent you was enforceable or not?

Would it be possible to post it up, having removed all personal details, so that people may give opinions?

                    Cheers
