I was in arrears with my service charge for a flat I live in a few months ago and the agent got a CCJ in court against me (I paid this off within the 30 day period so the CCJ was cancelled. I am now again in arrears with this account because money is short all the time and I have had letters from the agent telling me I must pay within seven days or further action with be taken, its over seven days now and I am worried that because they got a CCJ against me last time in court that they some how are able to just go straight to the bailiff stage with out going back to court over the new debt. Please can you advise me.

You settled the CCJ so the answer is no They have to go through the same proceedings again ......... however they can argue in court that it's not the 1st time they've been granted a CCJ because of your failure to pay on time which won't win you any sympathy............ Having stated the obvious tell us more about this 'service' charge what does it comprise of & how much is it & do you rent or lease the flat???Last edited by righty; 7th June 2010, 21:17:PM.
