  • Cabot Financial - Vodafone

    Hi I got a letter from cabot financial on the 19th April 2010 (day before yesterday) saying that i need to pay them 370 pounds (I dont have the exact amount here) for an unterminate contract with Vodafone back in 2003. I don't remember if that is true (i used to be really bad managing money when I was a student) but I havent heard from vodafone all that time... so it might not even be true..

    When I got the letter I remember straight away last year In June 2009, I had the exact same thing. It was also for vodafone and it was for the same contract (I have only used vodafone once).. I remember calling vodafone last year about it but they said they couldn't help me as they have got rid of my records (i got told off for calling about a 6 year old contract too!).. and that they had passed it on to another company.... I couldn't find any records of anything only the DCA had my stuff and they were saying those things were true (I dont' remember which DCA it was last June)....I thought I had no choice in the end I paid for it ... that was June 2009.

    Why do i get another letter 10 months later of the exact same thing? Most people will think that's not a big problem... but I use a pre paid master card and it only shows statements in the past 6 months.... therefore I can't print out a copy and say ... hey here's my prove i've paid it 10months ago...

    I thought the whole thing was strange so I did some research and found this website..... but I did call them the minute I got the letter as I paniced... i said they have made a mistake and that I will look into this to find prove for them... they said they will put a stop to it till this friday and they will call me....

    strangely they have also asked for my email address and home number but I said they didn't need to.... I hope I did the right thing..

    if someone who knows what to do please reply to this.,, I am really worried about this and also angry... I don't want to have to pay for it again just to make them go away... and I don't even know myself if the contract was really unterminated in 2003 in the first place...

    That's a statute-barred debt surely ?

    It's more than 6 years old so you wouldn't have to pay it even if it did exist.

      In edition, don't speak to them on the phone, get everything in writing. Cabot on quite untrustworthy at the best of times.

        Thank you both for such quick replies! it did calm me down a little

        I understand that if it's older than 6 years than I shouldnt even need to worry about (plus i don't think i owed anything anyway) but i don't remember the exact date of when i signed the contract... would it be wise to write to them and ask for a true copy of my contract at this stage? (just so that i have the date to prove that it's older than 6 years and tell them to leave me alone)..a lil worried about what they might do if i ignor their calls..

        how can I be sure my credit report is not affected by this?

          It's my understanding that the clock ticks from you made the LAST payment on that account, not when you signed the contract. If the last payment you made was in 2003, then it is certainly statute barred by now. It may be even have been statute barred when you paid the other DCA last year.

          Whatever, don't worry about it. They can rant and rave as much as they like, they can't touch you on it from what you have said here IMHO

            The contract started 2003 and ended in 2004.. if last payment was may 2004? would I be in trouble?

              If last payment was May 2004, then it just 'and only just' comes within the limits of not being a statute barred debt. However, you paid the outstanding balance in regard to this debt in full last year to another DCA. As long as you can prove this then it still makes no difference as they can't claim a debt from you that is settled in full.

                Thank you. I have just ordered just ordered my bank statements... hopefully i'll find the name of the DCA from last year and the amount i have paid.

                I am going to keep everything in writing when communitating with Cabot... see how it goes from here

                  You are very welcome.

                  If you do a search on here, you will find numerous threads regarding Cabot.

                  Curlyben is an expert on them as he has given them a good spanking on several occasions, and assisted numerous other members on this site to do the same.

                  Not seen Curlyben on here for quite a long time though !!

                    I have also received a letter last week for £1000 for a vodaphone bill that was paid in 2005, they are stating it wasnt & i need to gain proof, can anyone advise best action to take as it was paid on my mothers credit card

                      Copy of your mother's credit card statement for that date with the payment.

                        It's NOT your place to prove the debt was paid, but THEIR's.
                        After all THEY want payment.

                        When the next letter arrives throw a simple Prove It at them and see where that gets you.
