  • Can a lender sell a debt while it is in dispute?

    Hi Everyone
    I would appreciate if you can refer me to a law or document that prohibits lenders from selling a debt on while it is in dispute. I had a dispute with MBNA but they sold the debt to DCA during the complaint.

    In short yes they can and frequently do..
    Depending on the nature of the dispute they are meant to resolve them fully before selling them on, but frequently don't.

    CCA s78 (6) in default of your lawful request means they cannot take further action, which includes sale.

      Sorry. I am novice and a bit confused. Can you please clarify. On the one hand "they can" and on the other hand according to CCA s78 (6)"they cannot". Is there a case law or clarification on this you know of?
