  • Getting a Default Removed - Help please

    Hi, new to the forum and have a nightmare that I'd like some help with please.

    I applied for a couple of bank accounts recently and was declined, even with credit scores of 921 with experian.

    Spoke to experian who linked my file with my old address, even though they had it on file and a defaul notice via Aktiv Kapital was applied to it.

    The default relates to an overdraft I had with HSBC some 2 1/2 years ago and I paid the amount in full to Atkiv Kapital. Naively being told that because the debt was settled that my credit score would not be affected. As of today it's now gone down to 699 and is in the Poor category.

    Experian advised me that the only people that are able to get the Default removed are Aktiv Kapital.

    First phone call with them ended up with the call handler being aggressive and offensive over the phone. Called them back and spoke to their complaints department.

    They say that they're now going to apply for the relevant documentation from HSBC regarding the account that I defaulted on.

    Is there any way of getting the default removed, or am I screwed until 2013.

    Marking a credit file as 'settled' does not alter the damage that it causes. It might if it was read by a person, but because credit checking is automated, you will usually be rejected anyway with any one default or CCJ.

    You can attack the default if the penalty charges added on the the account BEFORE the date the default was registered add up to more than the amount it was defaulted for. In other words, if the whole default only happened because of unlawful charges applied. Part of it being charges won't hold up normally.

    The other thing to look at is whether the default process was done correctly, by checking the wording of the Default Notice and whether you were given the 14 days minimum time to correct the breach.

    Can you comment on these two options?

      It wasn't unlawful charges in my opinion. I'd used the overdraft, but not in an adequate time transfered the direct debits / standing orders over to the new account so they closed the account.

      Due to personal circumstances at the time it wasn't a priority.

      I don't even remember getting a default notice on the account.
