  • CapQuest 'Subject Access Information?'

    Hi -I am new member and already found site useful regarding CapQuest.
    They have just contacted me regarding a bank debt that I had to default on due to redundancy, illness, and now unemployment.
    I have already written to them- using your template- to ask for copy of agreement etc and including £1 postal order.
    They replied with two letters received on same day.
    The first stating that they have requested copy of agreement however, they have not purchased loan but are acting on behalf of bank and therefore no notice of assignment attached.



    The second letter said that as I require 'Subject Access Information' I should send:
    • Cheque for £10 for administration payable to CapQuest and marked ' Record Fee Only'
    • Proof of my identity linking me to my address
    They have advised they will put account on hold until 4 December but will progress if above not submitted.

    Can you advise on the way to progress? I am obviously not inclined to pay anything to CapQuest or provide any information especially as I have no proof of their relationship with the bank. They also did not acknowledge the postal order.

    Well you could save yourself money and write to the bank and ask if they have passed the debt to Capquest, and write to Capquest asking for proof that they are acting on behalf of the bank, then wait and see what comes back. That way you will have a starting point and know more.

      Thank you Sapphire- I was wondering though if CapQuest were being reasonable about their request?

        Sorry but DCA's and reasonable are not two things that go together, its really not in their vocabulary.

        Actually use the 'Prove it' letter in the CCA guide that should do the job.
